KPU Prepares Response Regarding Gibran's Vice Presidential Eligibility Lawsuit at Constitutional Court

The General Elections Commission (KPU) of the Republic of Indonesia, acting as the respondent, is drafting a response regarding the petition for the Dispute of General Election Results (PHPU) for the 2024 President and Vice President election in follow-up hearings at the Constitutional Court (MK).

The petitioners allege the invalidity of Gibran Rakabuming’s educational requirements during his candidacy for Vice President.

“We are preparing a response as the respondent to address the substance of the petition and the requests made by the Constitutional Court panel of judges presented during the hearing on Monday (21/9),” said KPU RI member Idham Kholik when contacted on Tuesday (22/9).

Idham also explained that in the nomination processes for legislative elections, Presidential elections, and Regional Head elections, the KPU acts as the end-user of nomination requirement documents provided by other institutions and submitted by candidates.

“In these nominations, the KPU performs an administrative function. During the nomination process, the wider public and society can provide input and feedback,” he added.

The parties filing this PHPU petition to the Constitutional Court include the Independent Election Monitoring Committee (KIPP), Partai Ummat, Denny Indrayana, six citizens part of the Forum of Retired TNI Soldiers, M Subhan, Bonatua Silalahi, and Tiurma M.S. Sihombing.

In their petitum, the petitioners are requesting the Court to declare that the educational requirements stipulated in Article 169 letter r of the Election Law are imperative and must be legally fulfilled at the time of registration and the determination of presidential and vice-presidential pairs.

The petitioners are asking the Court to declare the disqualification of Vice Presidential candidate Gibran Rakabuming Raka due to failure to meet the educational requirements regulated under Article 169 letter r of the Election Law.

Furthermore, the petitioners request the Court to declare that the determination of Gibran Rakabuming Raka as a vice-presidential candidate in the 2024 Election contained a legal defect from the outset and therefore has no legally binding force; and to declare the KPU Decision null and void insofar as it concerns the determination of Gibran Rakabuming Raka as Vice President.

Additionally, the petitioners are asking the Court to cancel the inauguration of Gibran Rakabuming Raka as Vice President to be conducted by the People’s Consultative Assembly (MPR).

Finally, the petitioners request the Court to order the MPR to hold a session to elect a Vice President from two candidates proposed by the President no later than 60 days after this decision is read.

Before closing the session, the Chief Justice of the Constitutional Court, Suhartoyo, stated that the examination hearing, with the agenda of hearing responses from the Respondent (KPU), statements from the Information Givers (Bawaslu), and Related Parties, will take place on Wednesday, 23 September 2026, at 19:00 WIB.
