KPK Responds to Mahfud MD on FA Case Transfer Not Complying with Criminal Procedure Code
Jakarta (ANTARA) - The Corruption Eradication Commission (KPK) has responded to remarks by former Coordinating Minister for Political, Legal and Security Affairs Mahfud MD that the handover of the corruption case involving Febrie Adriansyah (FA) does not comply with the Criminal Procedure Code (KUHAP).
“Yes, we respect the legal process that is currently under way, relating to the handover carried out by the National Police to the Attorney General’s Office,” said KPK spokesperson Budi Prasetyo at the KPK’s Red and White Building in Jakarta on Monday.
He explained that the KPK respects the move because the investigation into the case is still at an early stage, even though responsibility has been transferred from the Indonesian National Police (Polri) to the Attorney General’s Office (Kejagung).
Nevertheless, he said the KPK continues to follow developments in the handling of the case.
“At present we are still following developments in this investigation because the handover from the National Police to the Attorney General’s Office only took place on Saturday (11/7),” he said.
He explained that the KPK continues to follow or monitor developments because the investigation is still at an early stage, despite the transfer of handling from Polri to Kejagung.
“Yes, let us all be patient. We shall wait to see how things develop,” he said.
Meanwhile, he said the KPK views that both Polri and Kejagung have a strong commitment to handling the case and therefore deserve public support.
“Earlier we saw both the National Police Chief and the Attorney General openly convey the commitment of the two institutions to process this investigation professionally and transparently, so that the public can also monitor and follow every development in this investigation,” he said.
Previously, Polri’s Corruption Eradication Task Force (Kortastipidkor) announced on 6 July 2026 an investigation into an alleged corruption and money laundering case concerning the procurement and supply of coal for a number of steam power plants for the 2018-2026 period.
On 8 July 2026, the Polri task force began searching a number of locations. Polri explained that the searches related to three cases: the alleged coal supply corruption announced two days earlier, alleged corruption at the insurers Asabri and Jiwasraya between 2020 and 2025, and an alleged money laundering case in the settlement of a debt owed by PT CBS to PT KNI, which falls under the jurisdiction of the Metro Jaya Regional Police.
Febri Adriansyah, while still serving as Deputy Attorney General for Special Crimes (Jampidsus), held a press conference on 10 July 2026. He acknowledged that a house in Sentul, Bogor Regency, West Java, searched by the Polri task force belonged to him.
In the early hours of 11 July 2026, Kejagung announced that Febri Adriansyah had resigned from his post as Jampidsus, and that Attorney General ST Burhanuddin had accepted the resignation.
Later that afternoon, the Polri task force announced two suspects in connection with the three cases, one of whom was Febrie Adriansyah.
The Polri task force also announced it had decided to hand over the handling of the case to Kejagung.
Meanwhile, on 12 July 2026, Mahfud MD said on his official YouTube channel, Mahfud MD Official, that the handover did not comply with the KUHAP, and proposed that the KPK take over the investigation.
“The mechanism for the surrender or transfer of a continuing investigation does not exist in our criminal procedure law, and it has never happened before. There is no mechanism for transferring or moving investigative duties from the police to the Attorney General’s Office, or from the Attorney General’s Office to the police. There is no transfer from one investigator to another,” Mahfud said.
“There is indeed a possibility of a takeover, but in accordance with Article 10A of Law Number 19 of 2019 (on the Corruption Eradication Commission, ed.), such a takeover can only be carried out by the Corruption Eradication Commission, or KPK, over investigations conducted by the National Police or the Attorney General’s Office. The KPK can indeed take over, subject to certain conditions and reasons,” he continued.
