KPK Responds to Mahfud MD on FA Case Transfer Not Complying with Criminal Procedure Code

The Corruption Eradication Commission (KPK) has responded to a statement by former Coordinating Minister for Political, Legal and Security Affairs Mahfud MD regarding the transfer of a corruption case involving Febrie Adriansyah (FA), which he claimed did not comply with the Criminal Procedure Code (KUHAP). “Yes, we respect the ongoing legal process regarding the transfer carried out by the Police to the Attorney General’s Office,” said KPK Spokesperson Budi Prasetyo at the KPK’s Red and White Building in Jakarta on Monday. He explained that the KPK respects this because the investigation is still in its early stages, even though its handling has been transferred from the Indonesian National Police (Polri) to the Attorney General’s Office. Nevertheless, he said the KPK continues to follow the development of the case handling. “Currently, we are still following the progress of this case investigation because the transfer from the Police to the Attorney General’s Office was only carried out last Saturday (11/7),” he said. He explained that the KPK is still monitoring developments as the investigation process is still in its early stages, despite the transfer of handling from Polri to the Attorney General’s Office. “Let us be patient together. We will wait and see how it develops,” he said. Meanwhile, he said the KPK views that both Polri and the Attorney General’s Office have a strong commitment to handling the case, which deserves public support. “We have also seen openly conveyed by the National Police Chief and the Attorney General regarding the commitment of both institutions to process this investigation professionally and transparently, so the public can also monitor and oversee every development of this case investigation,” he said. Previously, the Corruption Eradication Task Force (Kortastipidkor) of Polri announced on 6 July 2026 an investigation into alleged corruption and money laundering in the procurement and supply of coal for several steam power plants for the 2018-2026 period. On 8 July 2026, Kortastipidkor Polri began searching several locations. Polri explained the searches were related to three cases: the alleged coal supply corruption announced two days earlier, alleged corruption in Asabri and Jiwasraya insurance for 2020-2025, and an alleged money laundering case in the debt settlement process of PT CBS to PT KNI under the jurisdiction of the Metro Jaya Regional Police. Febri Adriansyah, while still serving as Junior Attorney General for Special Crimes (Jampidsus), held a press conference on 10 July 2026, admitting that a house in Sentul, Bogor Regency, West Java, searched by Kortastipidkor Polri belonged to him. In the early hours of 11 July 2026, the Attorney General’s Office announced Febri Adriansyah’s resignation from the position of Jampidsus, which was accepted by Attorney General ST Burhanuddin. Later that afternoon, Kortastipidkor Polri announced two suspects in connection with the three cases, one of whom was Febrie Adriansyah, and decided to transfer the case handling to the Attorney General’s Office. On 12 July 2026, Mahfud MD stated on his official YouTube channel that the transfer did not comply with the KUHAP and proposed the KPK take over the investigation. “This mechanism of transferring or handing over further investigation does not exist in our criminal procedure law and has never happened before. There is no mechanism for transferring or moving investigative duties from the police to the Prosecutor’s Office, or from the Prosecutor’s Office to the Police,” Mahfud said. “Indeed, there is a possibility of a takeover, but in accordance with Article 10A of Law Number 19 of 2019 concerning the Corruption Eradication Commission, this takeover can only be carried out by the KPK against investigations conducted by the Police or Prosecutor’s Office. The KPK can indeed take over under certain conditions and reasons,” he continued.
