KPK Reminds Civil Servants That Holiday Gift Parcels Constitute Gratification

Jakarta, VIVA – The Corruption Eradication Commission (KPK) has affirmed that the giving of festive hampers or gift parcels to civil servants (ASN) or state officials in connection with their position falls under the category of gratuities.

Arif Waluyo, Director of Gratuities and Public Services at the KPK, speaking during a gratuity control socialisation event at the Ministry of Immigration and Correctional Services (Kemenimipas), said the provision is regulated under rules concerning gratuities.

According to Arif, the KPK also routinely issues circular letters on gratuity control ahead of religious holidays such as Idul Fitri, Christmas and Galungan.

He explained that hampers from work partners may not be given to civil servants or state officials, whilst gifts from colleagues are only permitted provided they meet the requirements set out in KPK guidelines.

Arif said there have been cases where a hamper from a work partner was received and subsequently reported to the KPK.

Under certain conditions, the item is declared state property, meaning the recipient who wishes to keep it must pay a substitute payment in accordance with the regulations.

If the recipient does not wish to keep the item, he said, the hamper can be returned to the sender.

Arif gave this explanation in response to a question from a socialisation participant representing vendors about the possibility of giving gifts to clients as a way of maintaining good relations.

He urged all providers of goods and services not to give gratuities to employees of the Ministry of Immigration and Correctional Services, as this could give rise to conflicts of interest.

“It can even be categorised as a bribe if it fulfils the elements set out in the laws and regulations,” he said, quoted on Wednesday, 22 July 2026.
