KPK Declines Appeal, Noel Ebenezer's Sentence Becomes Legally Binding
The Corruption Eradication Commission (KPK) has decided not to appeal the bribery and gratuity case concerning the processing of Occupational Health and Safety (K3) certifications involving defendant and former Indonesian Deputy Minister of Manpower, Immanuel Ebenezer. Consequently, the sentence of 4 years and 6 months imprisonment, a fine of Rp200 million subsidiary to 90 days of confinement, and a replacement payment of Rp3,435,000,000 subsidiary to 1 year imprisonment has become legally binding, or inkrah. During the previous verdict hearing, Noel also stated to the panel of judges that he accepted the decision.
“The KPK declares it fully accepts the panel of judges’ decision in the criminal case of bribery corruption related to the processing of K3 certification within the Ministry of Manpower with the defendant Mr. Immanuel Ebenezer Gerungan et al.,” said KPK Spokesperson Budi Prasetyo via a written statement on Monday (15/6). Besides Noel, there are 10 other defendants, including parties from the Ministry of Manpower and private sector individuals, who were also found guilty by the panel of judges at the Corruption Court (Tipikor) at the Central Jakarta District Court (PN). The KPK also stated it would not appeal their cases.
Budi said the KPK respects and appreciates the panel of judges’ decision, which examined, tried, and decided this case independently, objectively, and based on the legal facts revealed during the trial. He explained that the KPK observed the judges’ considerations adopted and agreed with the entire legal construction and juridical analysis of evidence presented by the KPK Public Prosecutor, including the articles applied in the indictment. This decision further confirms that the case handling process, from investigation and prosecution to evidentiary hearings, proceeded within the correct legal corridor, based on valid and convincing evidence in accordance with statutory provisions.
“The KPK also notes that all defendants have stated they accept the verdict,” Budi said. “Thus, this decision reflects that the judicial process has provided legal certainty for the parties involved, while also being an important part of efforts to enforce corruption laws justly,” he continued. Budi stated the KPK hopes the criminal sentences received by the defendants will have a deterrent effect. “The KPK hopes this decision can provide a deterrent effect, as well as serve as a lesson for all state administrators and government officials to always carry out their duties and authority professionally, transparently, and free from conflicts of interest,” Budi said.

Former Deputy Minister of Manpower Immanuel Ebenezer, sentenced to 4.5 years imprisonment, a fine of Rp200 million subsidiary to 90 days confinement, and a replacement payment of Rp3,435,000,000 subsidiary to 1 year imprisonment.
Irvian Bobby Mahendro, sentenced to 6 years imprisonment, a fine of Rp200 million subsidiary to 90 days confinement, and a replacement payment of Rp36.04 billion subsidiary to 3 years confinement.
Fahrurozi, Director General of Labour Inspection and K3 Development as of March 2025, sentenced to 4 years imprisonment, a fine of Rp200 million subsidiary to 90 days confinement, and a replacement payment of Rp35 million subsidiary to 1 year confinement.
Hery Sutanto, Director of Institutional Development from 2021 to February 2025, sentenced to 6.5 years imprisonment, a fine of Rp200 million subsidiary to 90 days confinement, and a replacement payment of Rp7,591,120,000 subsidiary to 2 years confinement.
