KPK Chairman Urges Caution in Adopting New Criminal and Criminal Procedure Codes

Jakarta (ANTARA) – KPK Chairman Setyo Budiyanto has emphasised to his staff the importance of caution in adopting the new Criminal Code (KUHP) and Criminal Procedure Code (KUHAP). ‘Even top riders like Valentino Rossi or Marc Marquez, despite being experts and world champions, can fall in a corner. I hope the KPK does not make legally risky mistakes,’ Setyo said in a statement confirmed in Jakarta on Thursday. Setyo had previously stressed this during the Knowledge Management Day event on the implementation of the new KUHP and KUHAP for KPK’s duties, held earlier this week. The forum focused on changes in the First Book of the new Criminal Code, which are deemed to have direct implications for proving corruption cases and KPK’s role as a specialised law enforcement agency (lex specialis). Despite Indonesia entering a phase of adjusting hundreds of sectoral regulations, the KPK has assured that corruption and money laundering crimes will continue to be treated as core offences with specialised handling and strict penalties. Previously, Law No. 1 of 2023 on the Criminal Code was signed by President Joko Widodo and promulgated by State Minister Pratikno on 2 January 2023. Meanwhile, Law No. 20 of 2025 on the Criminal Procedure Code was signed by President Prabowo Subianto and promulgated by State Minister Prasetyo Hadi on 17 December 2025. According to Article 369 of the Criminal Procedure Code, the regulations will take effect from 2 January 2026.
