KPK Assures Legal Process Against Former HSU District Prosecutor Follows Proper Procedure

The pre-trial hearing filed by Hulu Sungai Utara (HSU) District Chief Prosecutor Albertinus Parlinggoman Napitupulu at the South Jakarta District Court officially commenced on Friday (20 February).

The Corruption Eradication Commission (KPK), as the respondent, stated that it respects Albertinus’s legal challenge, as it is the right of every suspect to test procedures before the court.

“As a law enforcement institution, the KPK ensures that all case handling procedures have been carried out objectively and in accordance with prevailing legal provisions,” said KPK spokesperson Budi Prasetyo in a written statement on Friday (20 February).

“This includes the designation of suspects, which was based on sufficient preliminary evidence of alleged corruption offences,” he added.

Budi stated that the KPK is committed to upholding the principles of due process of law and the tenets of a fair, transparent and accountable trial.

In handling the alleged corruption case involving Albertinus, the KPK has been intensively coordinating and working in synergy with the Police and the Attorney General’s Office to ensure that the case handling process runs effectively in accordance with legal provisions.

“Nevertheless, the KPK continues to respect the right of every party to file legal remedies available within the judicial system, including pre-trial applications,” said Budi.

“The KPK will submit its official response to the substance of the pre-trial application in accordance with the hearing schedule set by the panel of judges at the South Jakarta District Court,” he concluded.

According to the South Jakarta District Court’s Case Tracking Information System (SIPP), the pre-trial application was registered on Friday, 23 January 2026, under case number 8/Pid.Pra/2026/PN JKT.SEL.

Albertinus is contesting the seizures carried out by the KPK in the handling of the alleged extortion case.

The KPK designated Albertinus, HSU District Prosecutor’s Office Intelligence Section Head Asis Budianto, and HSU District Prosecutor’s Office Civil and State Administrative Affairs Section Head Tri Taruna Fariadi as suspects in the alleged extortion case. All suspects have been placed in detention.

The suspects are charged under Article 12 paragraph (e), Article 12 paragraph (f) of the Corruption Eradication Act, in conjunction with Article 55 paragraph 1 sub-paragraph 1 of the Criminal Code, in conjunction with Article 64 of the Criminal Code.

After assuming the position of HSU District Chief Prosecutor in August 2025, Albertinus allegedly received cash flows of at least Rp804 million, both directly and through intermediaries, namely Asis and Tri Taruna as well as other parties.

The funds were derived from Albertinus’s alleged extortion of several regional agencies in HSU, including the Education Office, Health Office, Public Works Office, and the Regional General Hospital.

The case was uncovered by the KPK through a sting operation on 17–18 December last year.

During the ongoing process, the KPK searched the HSU District Prosecutor’s Office, Albertinus’s official residence as HSU District Chief Prosecutor, and his private residence in East Jakarta to seek evidence allegedly linked to the extortion case under investigation.

The KPK seized a number of documents and electronic evidence allegedly connected to the suspected criminal offences of extortion or budget skimming within the HSU District Prosecutor’s Office.

During the search of Albertinus’s official residence, the KPK also seized one vehicle registered to the Tolitoli Regency Government in Central Sulawesi.
