KP2MI suspends PT Duta Fadalima operations for procedural violations
The Ministry for the Protection of Indonesian Migrant Workers (KP2MI) on Thursday (20/8) partially suspended the business activities of PT Duta Fadalima, based in Kramat Jati, East Jakarta, for violating recruitment and placement procedures for Indonesian Migrant Workers (PMI) to the Middle East.
The company was proven to have carried out placements without holding a Permit for the Recruitment of Indonesian Migrant Workers (SIP2MI) and to have placed Prospective Indonesian Migrant Workers (CPMI) in a country declared closed.
Director of Supervision, Prevention, and Enforcement at KP2MI, Brigadier General Guritno Wibowo, said his team found two PMI who had been placed in Saudi Arabia without going through the Computerised System for the Protection of Indonesian Migrant Workers (SISKOP2MI) and without undergoing the pre-placement work process as required.
“KP2MI then carried out a series of handling measures, starting from completing the complaint documents, tracing, and analysing placement documents through SISKOP2MI. In addition, the Directorate General of Protection has twice summoned PT Duta Fadalima to provide clarification,” he said.
During the process, KP2MI obtained evidence of placements that did not comply with procedures as well as a Clarification Report with the company.
During the sanction period, the company is prohibited from conducting selection and processing placement documents for CPMI who have not signed a Placement Agreement, including Indonesian migrant workers who are currently on leave.
“PT Duta Fadalima is required to submit a list of Indonesian migrant workers who have been placed in the Middle East region over the past two years, as well as a list of PT Duta Fadalima’s business partners in the region,” said Guritno.
The company is also required to make a stamped statement letter containing its willingness to be responsible for the protection of PMI from the placement period until their return, as well as a commitment not to commit further violations.
“Furthermore, the company is required to prepare and submit a corrective action plan that includes strengthening the internal control system and supervision mechanism for the placement process. The company is also required to resolve the problems of CPMI and Indonesian migrant workers and fulfil the rights they should have received,” Guritno added.
The temporary suspension of business activities is part of efforts to supervise, prevent, and enforce regulations to ensure that the entire placement process runs according to procedure, while guaranteeing the protection and fulfilment of PMI rights.
