KontraS insists Andrie Yunus case must be brought to general court
Jakarta (ANTARA) - KontraS Working Body Coordinator Dimas Bagus Arya, while attending a meeting at the Indonesian House of Representatives (DPR RI), emphasised that the case of the acid attack on Andrie Yunus by several members of the Indonesian National Armed Forces’ Strategic Intelligence Agency (BAIS TNI) must be brought to a general court.
According to him, Commission III of the DPR RI also needs to show firmness in pushing for the determination of the jurisdictional forum or resolution of the case. Because, he assessed that the general court is more appropriate for trying the case.
“This case is more appropriate to be brought to the general court forum with all kinds of arguments that can later be assisted by my colleagues, my colleagues in the Advocacy Team for Democracy,” said Dimas at the parliamentary complex in Jakarta on Tuesday.
In addition, he expressed disappointment over the police’s statement handing the case to the TNI. Whereas, procedurally, there is no article in the Criminal Procedure Code that allows delegation to investigators who are not from PPNS.
“What is clear is that this process seems slow. Why? Because since the TNI Military Police (POM TNI) identified four suspected perpetrators on Thursday, 19 March, there has been no release of the faces or identities of the perpetrators,” he said.
Thus, he expressed concern about potential legal manipulation loopholes. He hopes the police still have good faith to continue handling the case using the Criminal Procedure Code (KUHAP).
Previously, the TNI Military Police Centre (Puspom TNI) detained four TNI personnel suspected of involvement in the acid attack case against KontraS Deputy Coordinator for the Commission on the Missing Persons and Victims of Violence (KontraS) Andrie Yunus.
“So, now these four suspected suspects have been secured at Puspom TNI for further investigation to the investigation level,” said Puspom TNI Commander Major General TNI Yusri Nuryanto in Jakarta on Wednesday (18/3).
Yusri also confirmed that the four people detained by Puspom TNI are TNI members serving at the Headquarters Detachment of the Strategic Intelligence Agency (Denma BAIS) TNI. The four perpetrators are initialled NDP, SL, BWH, and ES.
“We state that these four suspected perpetrators are all members of Denma BAIS TNI. So, not from any unit, but from Denma BAIS TNI,” he said.
