A member of the National Commission on Human Rights (Komnas HAM), Amiruddin Al Rahab, is pushing for the continuation of the fulfilment and restoration of rights for victims of gross human rights violations and their heirs. He stated that the restoration of victims’ rights needs to be regulated through a presidential regulation (perpres). This was conveyed during a Coordination Meeting of Ministries and Institutions organised by the Witness and Victim Protection Agency (LPSK) on Tuesday (23/6/2026). He explained that the restoration of rights for victims of gross human rights violations is currently governed by Presidential Instruction Number 2 of 2023 concerning the Implementation of Recommendations for the Non-Judicial Resolution of Gross Human Rights Violations. However, according to him, this rule appears to lack legal certainty. Amiruddin believes a presidential regulation is necessary to serve as a legal foundation. “A new political policy is needed, enacted through a presidential regulation. This is important as a legal basis and foundation for ministries and institutions in carrying out the work of fulfilling and restoring the rights of victims and their heirs,” Amiruddin said in a written statement on Wednesday (24/6). Amiruddin reminded that this effort must become a definitive state policy. This policy must be based on the paradigm that victim recovery positions victims as rights holders, not as recipients of aid. “This effort is the restoration of victims’ rights by the State, not placing victims as recipients of government assistance programmes,” Amiruddin clarified. He also assessed the importance of oversight. Previously, to monitor and evaluate the implementation of Presidential Instruction Number 2 of 2023, the President formed a Monitoring Team for the Implementation of Non-Judicial Resolution Recommendations for Gross Human Rights Violations (Tim Pemantau PPHAM), which was ratified in Presidential Decree Number 4 of 2023. However, this Presidential Decree expired in December 2023, meaning it has been absent for three years. “The implementation of the restoration of victims’ rights must be accompanied by a Monitoring Team involving prominent figures in the field of human rights, so that this recovery programme is truly carried out properly,” said Amiruddin.
