Komnas HAM Declares Sexual Violence at Pati Pesantren a Human Rights Violation
The National Commission on Human Rights (Komnas HAM) has concluded that the alleged sexual violence perpetrated by the founder of the Ndholo Kusumo Islamic Boarding School in Pati, Central Java, constitutes a human rights violation, not merely a criminal offence. The findings follow a monitoring process and the collection of testimonies from various parties.
Komnas HAM Chairperson Anis Hidayah stated that the case demonstrates an abuse of power, with the perpetrator allegedly exploiting his position as a pesantren leader and religious figure to control the victim. “The sexual violence occurred within a context of a power imbalance and involved psychological manipulation,” Anis said.
The commission found that the abuse first occurred when the victim was in junior high school around 2020 and allegedly continued repeatedly until 2024. The perpetrator is accused of using intimidation, physical violence, manipulation, and pornographic material to maintain control. Komnas HAM also noted strong indications that there were multiple victims, not just one.
The case was reported to the police by the victim’s father on 18 July 2024. However, Komnas HAM observed that the investigation faced obstacles, including alleged attempts to pressure the complainant into withdrawing the report and changes in testimony from some victims and witnesses. The commission described this as a “delay in justice.”
As a result of the case, the Ministry of Religious Affairs has revoked the operational licence of the Ndholo Kusumo Islamic Boarding School. Komnas HAM has recommended that the Central Java Police handle the case professionally, transparently, and with a victim-centred approach. The commission also urged the Ministry of Religious Affairs to strengthen oversight of pesantren and ensure that all affected students continue to receive a safe education. “This case is a reminder that educational institutions, including religious ones, must be safe spaces for children and all learners,” Anis concluded.
