Jakarta (ANTARA) - The Ministry of Communication and Digital (Kemkomdigi) has revealed the formula for the administrative fine scheme for Electronic System Operators (PSE) that violate provisions in the PP Tunas regulation. Secretary of the Directorate General of Digital Space Supervision at Kemkomdigi, Mediodecci Lustarini, explained that the development of this fine scheme uses a proportional approach based on the violation index and the business scale of the PSE. “In this process, we are developing a formula for administrative fines that uses a proportional approach based on the violation index and the business scale of the PSE,” said Mediodecci during a discussion in Central Jakarta on Monday. She explained that the administrative fine scheme for PSE violating PP Tunas is currently in the discussion stage with the Ministry of Finance to be proposed as Non-Tax State Revenue (PNBP). There are four components of the violation index that form the basis for determining the fine, namely the impact on children, the period or duration of the violation, the risk mitigation efforts already undertaken by the PSE, and the history of previous violations. Kemkomdigi has formulated the maximum fine limits for PSE according to their business scale. Micro enterprises are subject to a maximum fine of Rp1 billion, small scale up to Rp5 billion, medium scale up to Rp10 billion, and for large or global scale, up to 6 percent of global revenue. Mediodecci stated that the development of this administrative fine scheme has involved discussions with legal and economic experts. She emphasised that the imposition of these fines is intended to provide a deterrent effect for PSE that violate PP Tunas without going so far as to damage the industry. Mediodecci mentioned that PSE that violate have the right to appeal by submitting objections. If the formal objection is rejected, the PSE can pursue legal action through the State Administrative Court. “We guarantee the rights of PSE through a fair, transparent, and structured process in terms of space and time. Starting from submission, processing, determination, to delivery,” she said.
