Judicial Panel Determines State Loss of Rp140.86 Billion in PDNS Corruption Case
Jakarta — A judicial panel at the Corruption Court of the Jakarta Central State Court has determined that state losses in the case of alleged corruption at the Provisional National Data Centre (PDNS) amount to Rp140.86 billion.
Member judge Daru Swastika Rini explained that the state loss resulted from enrichment by several parties in the case, including PT Aplikanusa Lintasarta, representing a substantial loss to state finances.
“This is consistent with the findings of the audit report by the Financial and Development Supervisory Board (BPKP),” said Judge Daru during the reading of the judicial panel’s decision at the Corruption Court at Jakarta Central State Court on Tuesday.
Judge Daru stated that the audit findings were strengthened by various facts presented during the trial, including testimony from witnesses, expert witnesses and defendants, as well as documentary evidence.
The case involved the Director General of Information Technology Applications at the Ministry of Communication and Informatics from 2016 to 2024, Semuel Abrijani Pangerapan, as a defendant.
Semuel was also among those who benefited from the corruption, receiving bribes totalling Rp6.5 billion, received twice in 2021 comprising Rp1.5 billion and Rp5 billion.
The bribe money was received from defendant Alfi Asman in return for PT Aplikanusa Lintasarta being selected for several Ministry of Communication and Informatics projects.
There were four other defendants in the case of alleged corruption in procurement of goods and services and management of PDNS at the Ministry of Communication and Informatics from 2020 to 2022. These consisted of the Director of Business at PT Aplikanusa Lintasarta from 2014 to 2022 Alfi Asman and Account Manager at PT Dokotel Teknologi from 2017 to 2021 Pini Panggar Agusti, each sentenced to 6 years imprisonment.
Additionally, the Director of Government Information Technology Application Services at the Directorate General of Information Technology Applications at the Ministry of Communication and Informatics from 2019 to 2023 Bambang Dwi Anggono and the official responsible for commitment (PPK) in procurement of goods or services and management of PDNS at the Ministry of Communication and Informatics from 2020 to 2022 Nova Zanda were sentenced to 9 years and 5 years imprisonment respectively.
Like Semuel, the four defendants were each sentenced to a fine of Rp500 million with a subsidiary penalty of 140 days imprisonment.
For Bambang and Pini specifically, they were additionally ordered to pay restitution of Rp1.5 billion with a subsidiary penalty of 1 year imprisonment, and Rp1 billion with a subsidiary penalty of 6 months imprisonment respectively.
For their actions, the defendants were found guilty of violating Article 603 in conjunction with Article 20 letter c of the National Criminal Code in conjunction with Article 18 of Law Number 31 of 1999 on Combating Corruption Offences as amended and supplemented by Law Number 20 of 2001.
