Judge Transfers Nadiem Makarim to House Arrest
The panel of judges at the Jakarta Corruption Court has granted the request to transfer the detention of former Minister of Education, Culture, Research, and Technology Nadiem Anwar Makarim from prison detention to house arrest. This transfer of detention for Nadiem takes effect tomorrow.
The granting of the request to transfer Nadiem’s detention was read out directly by the Chief Judge of the Panel, Purwanto S. Abdullah, during a hearing held at the Jakarta Corruption Court on Monday (11/5/2026).
“It is hereby decided: first, to grant the request of the Defendant’s Legal Counsel to transfer the type of detention of the Defendant. Second, to transfer the type of detention of the Defendant Nadiem Anwar Makarim from detention at the Salemba State Detention Centre Branch of the Central Jakarta Prosecutor’s Office to house arrest at the Defendant’s residence located at The Residence at Dharmawangsa 2 Unit 1908 RT/RW 01/02, Pulo Ward, Kebayoran Baru Subdistrict, South Jakarta City, effective from 12 May 2026,” stated Purwanto when reading the verdict granting the request for Nadiem’s detention transfer.
Although granting the request, the judge also explained the matters that must be complied with by Nadiem as conditions for house arrest. The conditions are as follows:
A. The Defendant must remain within his residence at The Residence at Dharmawangsa 2 Unit 1908 RT/RW 01/02 in Pulo Ward, Kebayoran Baru Subdistrict, South Jakarta City for 24 hours a day and 7 days a week.
B. The Defendant is prohibited from leaving his residence for any reason except:
Undergoing surgery on 13 May 2026 and subsequent medical treatment at Abdi Waluyo Hospital or another designated hospital.
For medical check-ups that have previously obtained written permission from the Chief Judge of the Panel based on a written recommendation from the treating doctor.
Attending court hearings as scheduled by the Panel of Judges.
C. The Defendant must agree to have an electronic monitoring device installed on his body if the facilities are available at the Central Jakarta Prosecutor’s Office, with the stipulation that the Defendant is prohibited from removing, damaging, manipulating, or interfering with the device’s function, must immediately report any damage, and must ensure the device is always active and charged.
D. The Defendant must report directly to the Public Prosecutor at the Central Jakarta Prosecutor’s Office twice a week, namely on Mondays and Thursdays at 10:00 WIB to 12:00 WIB, unless impeded due to post-surgery health conditions evidenced by a doctor’s certificate.
E. The Defendant must surrender his Republic of Indonesia passport, any foreign passports, and all other travel documents to the Prosecutor at the Central Jakarta Prosecutor’s Office no later than 1x24 hours from the issuance of this decision.
F. The Defendant is prohibited from contacting, meeting, or communicating with witnesses or other defendants in this case or related cases, either directly or indirectly, whether through face-to-face, telephone, text messages, emails, social media, or other communication means.
G. The Defendant is prohibited from giving statements, interviews, or any comments to the mass media regarding this case without written permission from the Panel of Judges.
H. The Defendant is prohibited from receiving visitors other than immediate family members (spouse or biological children), registered legal counsel in the case file, and medical personnel based on a hospital assignment letter.
I. The Defendant must provide access to officers designated by the Central Jakarta Prosecutor’s Office to enter and inspect his residence at any time to ensure compliance with the house arrest conditions.
J. The Defendant must attend every court hearing as scheduled unless impeded due to post-surgery health conditions evidenced by a doctor’s certificate.
In the granting of the request, the panel of judges also explained that if Nadiem violates one or more of the stipulated conditions, the type of detention will be transferred back to prison detention at the State Detention Centre.
“Fifth, ordering the Public Prosecutor at the Central Jakarta Prosecutor’s Office to implement this decision, supervise the execution of house arrest, and report its implementation periodically to the Panel of Judges,” explained the judge.
“Sixth, ordering the Substitute Clerk to deliver copies of this decision to the Defendant, the Defendant’s Legal Counsel, the Public Prosecutor at the Central Jakarta Prosecutor’s Office, and the Head of the Salemba State Detention Centre Branch of the South Jakarta Prosecutor’s Office,” added the judge.
Purwanto emphasised that the panel of judges considered granting this request based on Nadiem’s health factors and not due to any other factors.
“Especially if anyone promises you something, report it immediately. There is absolutely none from the Panel of Judges. That’s all,” he concluded.
Meanwhile, Nadiem expressed his gratitude for the judge’s approval of his detention transfer request.
“I just want to say alhamdulillah, I am grateful to Allah, and I want to thank the panel for their humanity in granting the transfer of status to house arrest,” he added.
