The panel of judges stated that the element of financial loss to the state in the crude oil management corruption case had been fulfilled. The judges argued that there was a financial loss to the state amounting to Rp 9.4 trillion in the case, according to calculations by the State Audit Agency (BPK).

“Based on the results of the investigative audit report by the BPK RI No. 26 and so on, which was carried out in the context of calculating the financial loss to the state in the management of oil by the Ministry of ESDM, there was a financial loss to PT Pertamina of Rp 2,545,277,386,935 (2.5 trillion), which is part of the overall financial loss to the state in the sale of non-subsidized diesel by PT Pertamina and PT PPN in 2018-2023, totaling Rp 9,415,196,905,676.86 (9.4 trillion),” said Judge Sigit Herman Binaji while reading the verdict at the Central Jakarta Corruption Court, Thursday (26/2/2026).

The judge stated that the calculation of economic losses to the state at Rp 171,997,835,294,293 (171 trillion) was still speculative. The judge stated that the calculation was not real and not certain.

“The panel of judges considered that because the financial loss to the state was strengthened by the testimony of experts Nailul Huda and Wiko Saputra, and because it was speculative, the panel of judges considered that the calculation was speculative and there were many factors that influenced it, so it was not certain and not real, so it could not be proven that there was an economic loss to the state,” said the judge.

The judge stated that he agreed with the BPK’s calculation of the financial loss to the state in the sale of non-subsidized diesel by PT Pertamina and PT PPN in 2018-2023. However, the judge stated that he did not agree with the calculation of economic losses from experts Nailul Huda and Wiko Saputra.

“The panel agrees with the BPK’s calculation, except for the calculation of economic losses calculated by economic experts Nailul Huda and Wiko Saputra, which is still speculative, uncertain, because there are many factors that influence the formulation of calculating financial losses to the state, so there is not enough evidence regarding economic losses to the state,” said the judge.

“Considering that based on the series of considerations above, the element of being able to harm state finances has been fulfilled,” the judge continued.

In this case, the judge has handed down verdicts for Riva Siahaan (RS) as the former President Director of PT Pertamina Patra Niaga, Maya Kusmaya (MK) as the former Director of Marketing and Trading at PT Pertamina Patra Niaga, and Edward Corne (EC) as the former VP of Trading Operations at PT Pertamina Patra Niaga. The judge stated that Riva, Maya, and Edward had been proven guilty of corruption in this case.
