Judge States Kerry Was Not Entitled to Profit from OTM, Process Was Flawed from the Start

JAKARTA, KOMPAS.com - The panel of judges assessed that the defendant, who is also the Beneficial Owner of PT Orbit Terminal Merak (PT OTM) and PT Jenggala Maritim Nusantara (PT JMN), Muhamad Kerry Adrianto Riza, was not entitled to receive profits from the cooperation project with PT Pertamina because the procurement process was flawed from the beginning.

The Judge, Sigit Herman Binaji, first read out the points or arguments from the defendant’s side as conveyed in their plea.

“That, the defendant’s legal counsel in his defense stated that there was no state loss in the procurement of the ship worth 9,860,514.31 US dollars and Rp 1,073,619,047.00 (which is) the difference in profit for JMN from the receipt of lease payments from PT PIS,” said Judge Sigit Herman Binaji while reading out the sentencing considerations in a hearing at the Jakarta Corruption Court, Friday (27/2/2026).

But, the panel had a different opinion.

“The panel believes that because the procurement has been proven to be flawed, the defendant is not entitled to receive profits,” said Sigit.

The judge believes that the procurement process for the lease of the Merak fuel terminal through PT OTM and the leasing of ships through PT JMN was carried out unlawfully.

Thus, the series of actions in this procurement is considered to fulfill the element of harming state finances.

Today, Kerry Adrianto, together with the Commissioner of PT Navigator Khatulistiwa and also the Commissioner of PT Jenggala Maritim, Dimas Werhaspati; and the Commissioner of PT Jenggala Maritim and Director of PT Orbit Terminal Merak, Gading Ramadhan Joedo, faced sentencing for the case of corruption in the management of crude oil and refinery products of PT Pertamina Persero.

He was sentenced to pay compensation of Rp 2,905,420,300,854 or Rp 2.9 trillion or 5 years in prison.

Meanwhile, Gading and Dimas were each sentenced to 13 years in prison with a fine of Rp 1 billion or 190 days in prison.

The judge believes that the lease of the fuel terminal owned by PT OTM was an unlawful act.

This is because the fuel terminal was not an urgent need for PT Pertamina from the start.

But, because there was intervention from Kerry’s father, Mohamad Riza Chalid, the terminal lease project entered Pertamina’s investment plan in 2014.
