Judge States Andrie Yunus Shows Lack of Good Faith in Attending Trial
The Chairman of the Panel of Judges, Colonel Chk Fredy Ferdian, has highlighted the attitude of the Vice Coordinator of KontraS, Andrie Yunus. He stated that Andrie Yunus has not shown good faith in following the trial regarding the acid attack incident he experienced.
“The Prosecutor has facilitated this. In fact, the Prosecutor requested us to provide such facilities, and we have complied. The Prosecutor, who should represent the interests of the victim, is not being met with good faith from the victim,” said Fredy during the ongoing trial of the acid attack case against Andrie at the Military Court II-08 Jakarta on Tuesday (2/6/2026).
“Visiting is not permitted, and calling him is even more difficult. Yet, there are provisions under the Witness and Victim Protection Act (UU LPSK) that allow for testimony to be provided in various ways, even electronically, which we have facilitated,” Fredly explained.
He further explained that Law Number 13 of 2006 concerning the Protection of Witnesses and Victims stipulates that witnesses or victims who feel they are under serious threat may provide testimony without being physically present in court, subject to judicial approval. Specifically, paragraph 2 allows witnesses or victims to provide written testimony submitted before an authorised official, which is then signed and recorded in the official minutes.
Furthermore, according to Fredy, the law also allows witnesses or victims to be examined and provide statements via electronic means accompanied by authorised parties. “What does this mean? Can this be interpreted as the victim’s unwillingness to have their interests resolved comprehensively within this trial?” Fredy remarked.
The four defendants are Sergeant Two Edi Sudarko, First Lieutenant (Lettu) Budhi Hariyanto Widhi, Captain Nandala Dwi Prasetya, and Lieutenant (Lettu) Sami Lakka. The four defendants allegedly carried out their actions because they were offended by Andrie Yunus’s protest during the TNI Bill meeting at the Fairmont Hotel Jakarta on 16 March 2025.
“The defendants believe that Mr Andrie Yunus has insulted and trampled upon the TNI institution,” stated Military Prosecutor Lieutenant Colonel Corps Hukum (Chk) TNI Muhammad Iswadi during the hearing at the Military Court II-08 Jakarta.
The four defendants face multiple charges, including Article 469 paragraph (1) of the Criminal Code as the primary indictment, Article 468 paragraph (1) as a subsidiary charge, and Article 467 paragraph (1) and (2) as a further subsidiary charge, in conjunction with Article 20 letter c of Law Number 1 of 2023.
