JAKARTA, KOMPAS.com - The Military Court II-08 Jakarta has rejected the exceptions submitted by the legal counsel of the three accused TNI soldiers in the case of the murder of the Head of Branch (Kacab) of a state-owned bank, Mohammad Ilham Pradipta. The three defendants are Serka Muhammad Nasir, Kopda Feri Heriyanto, and Serka Frengky Yaru. “It is hereby declared that the objections raised by the Defendants and their Legal Counsel Team are rejected. It is stated that the Military Court II-08 Jakarta has jurisdiction to try the case of the Defendants, and the examination of the case shall proceed,” said the Chief Judge of the Panel, Colonel Chk Fredy Ferdian Isnartanto, in the courtroom of the Military Court II-08 Jakarta on Wednesday (15/4/2026). He explained that the next hearing, which is the examination of witnesses, will be held on Monday (27/4/2026). According to him, the combination of the case files of the defendants constitutes a single chain of actions in the same criminal offence. “The Panel of Judges considers that the combination of the case files of the defendants is a series of actions that occurred when the criminal offence was committed by the Defendants. Although the roles of the Defendants have different duties, all will be clarified during the examination of the witnesses in the trial facts,” said Fredy. He explained that the combination or separation of case files is the authority of the Military Prosecutor in preparing the indictment. “If the case files of the Defendants are combined into one case file in accordance with the principles of swift, simple, and low-cost justice with legal certainty for all parties,” clarified Fredy. “Regarding this argument, the Panel of Judges considers that the Military Prosecutor has sufficiently included a careful, clear, and complete description with the identities of the Defendants,” explained Fredy. He added that the description of the facts and the charged articles will be further proven in the trial. Meanwhile, regarding the legal counsel’s objection concerning the determination of suspects and defendants, which was deemed not to meet the minimum of two pieces of evidence, the panel of judges also rejected that argument. “In this matter, the panel of judges considers that the involvement of the three defendants in this case is already in accordance with the statements of the witnesses and meets the formal requirements as described in the prosecutor’s indictment, where the roles of the Defendants have been explained in the Military Prosecutor’s indictment,” he explained. Previously, the Military Prosecutor’s Office (Otmil) II-07 Jakarta charged Serka Mochamad Nasir, Kopda Feri Herianto, and Serka Franky Yari in the premeditated murder case of the Head of Branch (Kacab) of a state-owned bank, Mohammad Ilham Pradipta, at the Military Court II-08 Jakarta.
