The legal counsel for Indonesia’s 7th President, Joko Widodo (Jokowi), Rivai Kusumanegara, has responded to a second pre-trial motion filed by Roy Suryo. Roy has lodged a new motion with the South Jakarta District Court to challenge the validity of his suspect designation in a case concerning allegations of a fake diploma against Jokowi.

Rivai stated that while he respects the first pre-trial motion as a legal recourse, he considers the second motion illogical. He explained that the motion is illogical because it seeks to test the validity of a suspect designation when the case has already proceeded to trial and is no longer at the investigation stage. Furthermore, the applicant is no longer a suspect but a defendant, making it impossible to review a process that has already been passed, especially as the case file is no longer with investigators.

Rivai suggested that if Roy objected to the construction of the charges, he should have filed an exception rather than a pre-trial motion. He also suspects the second motion is merely a tactic to delay the main trial proceedings. Rivai expressed hope that the pre-trial judge would firmly reject the motion.

Roy Suryo’s second pre-trial motion was registered with the South Jakarta District Court on 2 July 2026 under case number 108/Pid.Pra/2026/PN JKT.SEL. The motion names the Metro Jaya Police Chief and the Jakarta High Prosecutor’s Office as respondents. Roy’s legal counsel, Refly Harun, confirmed the motion aims to challenge the application of Article 32 paragraph (1) of the Electronic Information and Transactions Law, arguing the evidence used was insufficient.
