The Jakarta High Court (PT DKI) delivered its appeal verdict for crude oil governance corruption defendant Muhamad Kerry Adrianto Riza on Wednesday (10/6). The son of oil graft fugitive Riza Chalid had his 15-year prison sentence upheld.

“Sentencing the defendant to 15 years in prison,” said Presiding Judge Budi Susilo while reading the appeal decision at the Jakarta High Court in Cempaka Putih, Central Jakarta.

In addition to the prison sentence, the panel of appeal judges imposed a fine of Rp500 million, which if unpaid will be replaced by 140 days in custody. This fine is lower than the first-instance ruling, which set the fine at Rp1 billion.

However, the judges increased the compensation payment liability that Kerry must bear. The appeal ruling set the total compensation at Rp13,406,493,622,901, or approximately Rp13.4 trillion.

“In the event that the convicted individual does not have sufficient assets to pay the compensation, a prison sentence of 10 years shall be imposed,” the judge stated.

During the first-instance trial at the Central Jakarta Corruption Court, Kerry was also sentenced to 15 years in prison. At that time, he was fined Rp1 billion, subsidiary to 190 days in custody, and ordered to pay compensation of Rp2,905,420,003,854, with a subsidiary sentence of five years in prison.

“Declares defendant Muhamad Kerry Adrianto proven legally and convincingly guilty of committing a criminal act of corruption jointly, as charged in the primary indictment,” said Presiding Judge Fajar Kusuma Aji during the verdict reading at the Central Jakarta Corruption Court last Friday (27/2).

In its considerations, the first-instance panel affirmed that the element of state financial loss in the crude oil governance corruption case was proven. The judges referred to the Supreme Audit Agency’s (BPK) investigative audit report, which recorded state losses reaching Rp9.4 trillion.

“Based on the results of the investigative examination report by BPK RI Number 26 et cetera, conducted in the context of calculating state financial losses in oil governance under the Ministry of Energy and Mineral Resources, there were state financial losses suffered by PT Pertamina amounting to Rp2,545,277,386,935, which is part of the total state financial losses in the sale of non-subsidised diesel by PT Pertamina and PT PPN from 2018 to 2023 amounting to Rp9,415,196,905,676.86,” said member judge Sigit Herman Binaji while reading the verdict at the Central Jakarta Corruption Court on Thursday (26/2).

At that time, however, the judges assessed that the calculation of state economic losses amounting to Rp171.9 trillion presented in the case was still presumptive. According to the panel, the loss value could not yet be definitively ascertained and therefore could not be used as a precise basis for calculation.

  6. Agus Purwono, former VP Feedstock Management of PT Kilang Pertamina Internasional, sentenced to 10 years in prison and a Rp 1 billion fine subsidiary to 190 days in custody.

  7. Muhamad Kerry Adrianto Riza, beneficial owner of PT Navigator Khatulistiwa, sentenced to 15 years in prison, a Rp 1 billion fine subsidiary to 190 days in custody, and compensation of Rp 2,905,420,003,854 subsidiary to 5 years in prison.

  8. Dimas Werhaspati, Commissioner of PT Navigator Khatulistiwa and Commissioner of PT Jenggala Maritim, sentenced to 13 years in prison, a Rp 1 billion fine subsidiary to 190 days in custody.

  9. Gading Ramadhan Joedo, Commissioner of PT Jenggala Maritim and President Director of PT Orbit Terminal Merak, sentenced to 13 years in prison, a Rp 1 billion fine subsidiary to 190 days in custody.
