Jakarta Administrative Court Annuls Minister's Staff Transfer Decree
The Jakarta State Administrative Court (PTUN) has granted the entire lawsuit filed by Ministry of Human Rights (HAM) employee Ernie Nurheyanti M. Toelle against Minister Natalius Pigai. The dispute concerned a job transfer decision made in early 2026.
In its ruling, the panel of judges declared the Minister of Human Rights Decree Number MHA-14 KP.04.04 dated 23 January 2026, which served as the basis for Ernie’s transfer, null and void and ordered its revocation. The verdict was read out on Thursday, 2 July 2026, and recorded in the Supreme Court’s e-Court system.
The case originated from a transfer decision issued by the Minister of Human Rights through the decree dated 23 January 2026. Under this decision, Ernie was moved from her position as Secretary of the Directorate General of Human Rights Services and Compliance, an Echelon IIA managerial role, to a functional position as a Senior Human Rights Analyst.
The panel of judges declared that the Ministerial Decree no longer has legal force and must be revoked. The court also ordered the defendant, Minister Natalius Pigai, to restore Ernie Nurheyanti’s position, honour, and dignity to her previous role as Secretary of the Directorate General of Human Rights Services and Compliance. Additionally, the defendant was ordered to pay court costs amounting to Rp383,000.
