Interim Ruling Rejects Objection, Opening New Phase in Former Jampidsus Febrie Case
JAKARTA — The panel of judges instructed public prosecutors to proceed directly with proving the case against former Deputy Attorney General for Special Crimes (Jampidsus) Febrie Adriansyah. The judges ordered prosecutors to present witnesses, experts and evidence to substantiate the indictment against Febrie.
“The defendant’s objection, submitted by Febrie Adriansyah’s lawyers, will be decided together with the final judgment,” presiding judge Akhmad Fijiarsyah Joko Sutrisno said while reading the interim ruling rejecting the defendant’s preliminary objection at the Jakarta Corruption Court on Monday (26 October 2026).
In its reasoning, the court rejected the arguments put forward by Febrie and his legal team. Febrie’s side had argued that a money-laundering charge must be preceded by an underlying criminal offence. Febrie is charged with extortion and money laundering.
“The panel is of the view that the objection based on the underlying offence not having been charged separately does not, at this stage, demonstrate a defect that would render the indictment null and void, provided that the indictment meets the requirements set out in Article 75(2)(b) of Law No. 20 of 2025 on Criminal Procedure,” Akhmad said.
The panel therefore considered that the omission of the underlying offence from the indictment could not be used as grounds to halt the examination of the substance of the case.
“The final assessment of this argument, including whether the elements of the money-laundering offence have been proven, will be considered after the evidentiary examination and determined together with the final judgment,” Akhmad said.
Febrie Adriansyah, along with Don Ritto and Nurman Herin, is accused of extorting Rp55 billion from businessman Tan Kian to prevent him from being named a suspect in a corruption case involving PT Asuransi Jiwasraya. Febrie is also charged with money laundering involving Rp350 billion, comprising Rp46,743,821,282 and US$440,990.
