JAKARTA, KOMPAS.com - The Ministry of Agrarian Affairs and Spatial Planning/National Land Agency (ATR/BPN) reminded the public who receive land as a gift from parents to promptly carry out the process of transferring the certificate name (balik nama) so land ownership has lawful certainty. Head of Public Relations and Protocol Bureau of ATR/BPN Shamy Ardian said the process of hibah and balik nama must be carried out in the correct stages to avoid legal problems later. ‘First, ensure there is no boundary dispute. Second, ensure there is no dispute of ownership,’ Shamy said, quoted from the ATR/BPN website, Wednesday (20/5/2026). According to him, before the hibah process is carried out, the public needs to update data at the local Land Office (Kantor Pertanahan/ Kantah) by bringing documents such as geotagging photo printouts, original land certificate, and identity card (KTP). ‘After that, please coordinate with the Land Deed Making Official (PPAT) to register certificate checks,’ he explained. ‘After the results of the certificate check are released, continue with the process of settlement of state revenue, such as Land and Building Acquisition Duty (BPHTB) and the current year’s Land and Building Tax (PBB),’ he said. The next stage is the making of a grant deed in front of the Land Deed Making Official (PPAT) signed by the grantor and the grantee. After all documents are complete, PPAT will upload the files to the BPN electronic system for examination and verification. ‘Then PPAT will upload the documents to BPN’s electronic system to be checked all documents, including validity, then the cover letter and so on are uploaded all,’ continued Shamy. If all documents have been verified and declared complete, the physical files will be brought to Kantah for balik nama processing. According to standard operating procedures, the balik nama process is completed within five working days. ‘After completing the balik nama process, the certificate that previously bore the parents’ name becomes that of the child,’ he concluded.
