Indonesian legal logic
Indonesian legal logic
According to the Indonesian Civil Law any child of an Indonesian mother and a foreign father has no choice but to follow the father's nationality, unless the marriage is not registered, then the child will be Indonesian.
Should the mother die, the child will not inherit the mother's landed property because according to Indonesian Property (Agrarian) Law only Indonesians are allowed to own property. Secondly, if there is a divorce, then the mother does not have the worldwide practice of first right of child custody.
It appears that if this is the right state of legal logic, Indonesian ladies must waive their universal motherhood rights or else remain illegally married if the male partner is not Indonesian.
I call on proper authorities for comments to set the record straight.
