“The Personal Data Protection Law remains in force, and we will continue to safeguard our citizens’ data,” she said in Jakarta on Wednesday.

Hafid explained that the agreement strengthens existing data flow practices, noting that cross-border data transfers are not new, as they have long occurred through the use of international digital platforms, including those based in the United States.

According to her, the agreement provides a clearer legal framework for data transfer practices that have been in place for years.

She stressed that the government remains committed to protecting the personal data of Indonesian citizens. As a sovereign nation, Indonesia continues to uphold its Personal Data Protection Law, she added.

Meanwhile, Haryo Limanseto, spokesperson for the Coordinating Ministry for Economic Affairs, also underlined that data transfers agreed under the trade pact are subject to the Personal Data Protection Law.

He explained that the data referred to in the agreement are those required for business activities. Cross-border data transfers form a key infrastructure component for e-commerce, digital financial services, cloud computing, and other digital services.

“The government ensures that the transfer of data, both physically and digitally, is conducted within a secure and reliable data governance framework, without compromising citizens’ rights,” he said in a statement issued on Sunday (February 22).

He added that clear regulations on data transfers will strengthen Indonesia’s position as a regional digital economy hub, as global technology companies require legal certainty to facilitate cross-border data processing while ensuring adequate data protection.

“With credible governance, Indonesia can attract investment in data centers, cloud infrastructure, and other digital services,” he said.
