The legal team of PT Indobuildco has requested that the planned execution of the Hotel Sultan land not be forced and must comply with applicable procedural laws, as well as not violate human rights guaranteed by the 1945 Constitution.

Hamdan Zoelva, the legal representative of PT Indobuildco, stated that the execution determination should not be interpreted as if all legal issues have been resolved. He noted that the legal process regarding the Hotel Sultan area is still ongoing, with room for resolution through negotiation and mediation.

“PT Indobuildco respects the court and every ongoing legal process. However, the execution of Hotel Sultan should not be forced. Every execution plan must truly adhere to the law and must not disregard legitimate rights, workers’ rights, tenants’ rights, and other affected parties,” Hamdan said in his statement on Thursday (7/5).

Hamdan explained that while the latest civil decision Number 208 of 2025 does order the evacuation of the Hotel Sultan area, the panel of judges in their considerations explicitly emphasised the importance of a fair resolution through negotiation and peace.

This, according to Hamdan, aligns with the considerations of the Case Review Decision Number 276 PK/Pdt/2011, which also affirms that PT Indobuildco’s rights as an investor existed previously, including the investments already planted on that land.

“That PK decision affirms that because Indobuildco’s rights as an investor already existed previously along with the investments planted, the parties should make efforts to resolve it through negotiation to achieve a fair outcome for both sides. This is important to maintain the investment climate in Indonesia,” he said.

Therefore, Hamdan believes that the execution should be postponed because the negotiation and mediation process is still ongoing, and peace between the parties will soon be achieved.

“If the negotiation and mediation process is ongoing, especially since peace will soon be achieved, then the execution should not be forced. The court must view this case holistically, not just from the formal side of the execution determination,” he said.

Hamdan also reminded that the Hotel Sultan area is not just about land issues. It also concerns business activities, employees, tenants, business partners, and the continuity of businesses that have been running for decades.

“The court must be very careful. There are employees, tenants, business partners, and parties who depend on their livelihood from the Hotel Sultan business activities. If that area is taken over hastily, the impact will not only be on PT Indobuildco, but also on many parties,” he said.

Furthermore, Hamdan emphasised that PT Indobuildco is not opposing the state. He stated that the stance taken is to ensure that every legal process runs fairly, cautiously, and does not disregard legitimate rights.

Previously, the Central Jakarta District Court (PN Jakarta Pusat) carried out konstatering or verification of the disputed object data as a follow-up to the planned execution of the Hotel Sultan Jakarta land on Monday (16/3).

Based on observations by CNNIndonesia.com, this konstatering was attended by representatives from PN Jakpus, the State Secretariat Ministry and the Gelora Bung Karno Complex Management Centre (PPKGBK) as the execution applicants, the Agrarian Affairs and Spatial Planning Ministry/National Land Agency (ATR/BPN), up to the police.

“Konstatering in the sense of matching, ensuring that the boundaries match what we requested from us as applicants two PPKGBK and applicant one Kemensetneg regarding state property in Block 15,” said PPKGBK President Director Rakhmadi Afif Kusumo to reporters on Monday.

“This morning we heard directly from the clerk that konstatering for Block 15 has been carried out, checking the ex-HGB 26 and ex-HGB 27 which should already be state property,” he added.

Rakhmadi also affirmed that the Hotel Sultan land is state-owned land, so the execution process will continue.

“So from our side, we adhere to the fact that this is already final in the sense of BMN (State Property), where this property is already state-owned. Our spirit from the leadership’s direction from Kemensetneg is of course how to secure that state property, optimise it,” he said.
