The Attorney General’s Office (AGO) prosecutors have stated that the criminal indictment in the alleged corruption case involving the procurement of Chromebook laptops and Chrome Device Management (CDM) for the 2020-2022 fiscal years, with defendant Nadiem Anwar Makarim, spans 1,597 pages.

“We need to convey and request approval from Your Honour and the legal counsel. Given that this indictment document is 1,597 pages thick, systematically compiled from the introduction, trial facts, fact analysis, legal analysis, and conclusion,” said prosecutor Roy Riady at the Corruption Court (Tipikor) at the Central Jakarta District Court (PN), on Wednesday (13/5).

The prosecutors proposed reading only the key points of the indictment, namely the introduction and legal analysis sections. Nadiem’s legal counsel had no objections, leaving the decision to the panel of judges.

“Very well. Clearly, the essence is fully contained. Perhaps the legal analysis regarding doctrines and opinions does not need to be read out,” said the chief judge Purwanto S Abdullah.

“Ready, Your Honour,” replied the prosecutor.

Before beginning the indictment reading session, the judge inquired about Nadiem’s health condition.

Nadiem stated he was ready to proceed with the trial.

“Your Honour, thank you. Insha’Allah, I am ready to face today’s trial. Tonight I will undergo surgery, straight from here,” said Nadiem.

Nadiem is being prosecuted for the criminal act of corruption that harms the state finances by Rp2.18 trillion related to the education digitalisation programme involving the procurement of Chromebook laptops and CDM within the Ministry of Education, Culture, Research, and Technology (Kemendikbudristek) for 2020-2022.

The corruption is alleged to have been committed, among others, by carrying out the procurement of information and communication technology-based learning facilities in the form of Chromebook laptops and CDM for the 2020, 2021, and 2022 fiscal years not in accordance with the procurement planning and procurement principles.

The acts were carried out jointly with other defendants in separate trials, namely Ibrahim Arief alias Ibam, Mulyatsyah, Sri Wahyuningsih, and Jurist Tan, who is currently a fugitive.

In detail, the state losses include Rp1.56 trillion related to the education digitalisation programme at Kemendikbudristek, as well as US$44.05 million or equivalent to Rp621.39 billion due to unnecessary and unbeneficial CDM procurement.

Through these acts, Nadiem is alleged to have received money amounting to Rp809.59 billion originating from PT Aplikasi Karya Anak Bangsa (PT AKAB) via PT Gojek Indonesia. It is stated that most of PT AKAB’s funds came from Google’s investment of US$786.99 million.

Meanwhile, Ibam, Mulyatsyah, and Sri Wahyuningsih have been convicted guilty with varying sentences.

Ibam, as a consultant at Kemendikbudristek, was sentenced to four years’ imprisonment and a fine of Rp500 million subsidiary 120 days’ imprisonment.

The verdict against Ibam was marked by a dissenting opinion from two member judges, Eryusman and Andi Saputra.

Meanwhile, Mulyatsyah, as former Director of SMP at Kemendikbudristek in 2020, received a sentence of 4.5 years’ imprisonment and a fine of Rp500 million subsidiary 120 days.

He was also imposed an additional sentence of repayment of replacement money amounting to Rp2.28 billion subsidiary two years’ imprisonment.

As for Sri Wahyuningsih, former Director of Primary Schools at the Directorate General of Early Childhood Education, Basic Education, and Secondary Education in 2020-2021, she was sentenced to four years’ imprisonment and a fine of Rp500 million subsidiary 120 days’ imprisonment.

The cases of Mulyatsyah and Sri Wahyuningsih have attained final legal force or are inkrah.
