ILEF 2026 Highlights Corporate Criminal Law Enforcement Direction Six Months After New Criminal Code Takes Effect

The new National Criminal Code (KUHP) has been in effect for approximately six months, ushering Indonesia’s business world into a new era of corporate criminal liability. Addressing the need for legal certainty during this transition, the Indonesian Advocates Association Suara Advokat Indonesia (PERADI SAI) organised the Indonesia Legal & Economic Forum (ILEF) 2026 with the theme ‘Corporate Criminal Liability After the New Criminal Code: Challenges and Perspectives from Law Enforcement in the First Six Months.’ PERADI SAI Chairman Harry Ponto stated that the implementation of the National Criminal Code brings significant consequences for corporate governance, risk management, and compliance systems. ‘The business world needs certainty on how corporate criminal provisions will be applied in practice. We present this forum to bring together regulators, law enforcement officials, advocates, and business actors in a constructive dialogue so that legal certainty and the investment climate can go hand in hand,’ Harry said. Organising Chairman Daniel Ginting noted that ILEF 2026 featured speakers at the forefront of national criminal law policy formation and execution, including Supreme Court Justice H. Surya Jaya, Senior Public Prosecutor Erni Mustikasari from the Attorney General’s Office, and Brigadier General Boy Rando Simanjuntak, Head of the Investigation Supervisory Bureau at Bareskrim Polri. The event was opened by House of Representatives Commission III Chairman Habiburokhman. ‘Corporations are the engines of the nation’s economy, but legal certainty is the main anchor. The implementation of the new Criminal Code must deliver fair and accountable law enforcement while supporting the creation of a healthy investment climate,’ said Habiburokhman, who is also a member of PERADI SAI. The forum also featured Pandu Sjahrir, Chief Investment Officer of BPI Danantara, and Sofyan A. Djalil, Chief Executive Officer of the Indonesia Business Council (IBC). Through ILEF 2026, PERADI SAI hopes to foster a better understanding of the direction of corporate criminal provisions in the National Criminal Code, while strengthening dialogue between policymakers, law enforcement, advocates, and business actors to build a healthy, high-integrity, and sustainable investment climate.
