ICW Reports BGN Leadership to Ombudsman Over Concurrent BUMN Positions

Indonesia Corruption Watch (ICW) has reported the leadership of the National Nutrition Agency (BGN) to the Ombudsman over alleged maladministration for holding concurrent positions in state-owned enterprises (BUMN). The report was filed on Thursday, 2 July 2026.

According to Wana Alamsyah, Head of the Legal and Investigation Division at ICW, all principal leaders of the agency responsible for the free nutritious meal programme (MBG) are recorded as simultaneously holding positions in various BUMNs. These include BGN Head Nanik Sudaryati Deyang, who serves as a Commissioner of PT Pertamina (Persero), and Deputy Head Agustina Arumsari, who holds a position as Deputy Chief Commissioner of PT Pertamina Patra Niaga. Another Deputy Head, Trenggono, is listed as a Deputy Chief Director of PT Agrinas Pangan Nusantara.

Wana stated on Saturday, 4 July 2026, that the practice of holding concurrent positions potentially violates Law Number 25 of 2009 concerning Public Services. He explained that BGN leaders qualify as public service providers because the agency directly implements the MBG programme, and therefore they must comply with Article 17 letter a of the law, which prohibits public service providers from concurrently serving as commissioners or directors of business organisations.

Furthermore, ICW argues that the concurrent positions contradict Constitutional Court Decision Number 128/PUU-XXIII/2025, which prohibits ministers and deputy ministers from holding concurrent positions as commissioners or directors in state-owned or private companies. Wana noted that the Head of BGN holds a ministerial-level position and thus should be subject to the same principle.

“The Head and Deputy Heads of BGN are appointed and dismissed by the President and receive facilities equivalent to Ministers and Deputy Ministers, so there is no constitutional reason to treat them differently,” Wana said.

ICW has urged the Ombudsman to investigate the alleged maladministration and issue a recommendation to President Prabowo Subianto to dismiss the officials involved. The organisation stressed that allowing this practice to continue contradicts the government’s commitment to reforming the MBG programme following previous corruption allegations.
