Even after a divorce is officially finalised by the court, your marital status on your ID card (KTP) may still show as ‘married’. Jakarta’s Civil Registry Office (Dukcapil) is reminding citizens who have divorced not to forget to update their status in their population administration documents.

For information, a divorce ruling from the court does not automatically change the marital status on population documents; therefore, administratively, one remains married even if legally divorced. Based on Law Number 24 of 201le regarding the Amendment to Law Number 23 of 2006 on Population Administration, every significant event—such as births, deaths, marriages, and divorces—must be reported.

To report a divorce registration at Dukcapil, the following documents must be presented:

  • A photocopy of the court decision copy that has permanent legal force

  • The original marriage certificate extract

  • The original e-KTP

  • The original Family Card (KK)

  • For Muslims, the divorce certificate is issued directly by the Religious Court

  • For non-Muslim residents, the divorce certificate is issued by Dukcapil following a court decision that has permanent legal force

Failure to report a divorce registration can lead to complications in accessing public services. Once officially divorced, ensure the change is recorded with Dukcapil to avoid being trapped in an incorrect status on official documents.

How to Create a Marriage Agreement

A marriage agreement is a written agreement made between prospective spouses to regulate matters within the marriage, particularly regarding assets. This is also known as a prenuptial or postnuptial agreement.

Based on Article 29 of Law Number 1 of 1974 and Article 98 of Ministry of Home Affairs Regulation Number 108 of 2019, a marriage agreement can be made in writing by mutual consent and legalised by Dukcapil officials. According to Dukcapil Jakarta, a marriage agreement can be established at the following times:

  • Before marriage (before the wedding ceremony or registration)

  • At the time of marriage (on the wedding day)

  • During the marriage (within the marriage bond, including amendments and revocations)

The following documents are required to create a marriage agreement:

  • A marriage agreement deed prepared by a notary located within the territory of the Republic of Indonesia (the notary deed must be legalised)

  • Marriage certificate extracts for both husband and wife

  • Photocopies of the e-KTP for both husband and wife

  • Photocopies of the Family Card (KK) for both husband and wife

Marriage agreements made before or at the time of the wedding can be registered alongside the marriage registration. If the agreement is made during the marriage, a joint statement letter from both partners may be attached.

Applications for marriage agreements can be submitted via:

  • For Indonesian citizens: At the Jakarta Provincial Dukcapil Sub-Department

  • For marriages involving foreign nationals: At the Jakarta Provincial Dukcapil implementation unit
