How Long Does the Certificate Release Process Take After a Mortgage is Paid Off?
JAKARTA - After settling a home ownership credit (KPR), many people believe that the administrative matters regarding home ownership are complete. However, homeowners still need to apply for the release (roya) of the certificate at the Land Office so that the bank’s mortgage right can be officially removed. This process is essential because a land or house certificate that is still recorded as bank collateral is not fully clear even if the instalments have been paid off. According to the Head of Public Relations and Protocol Bureau of the Ministry of Agrarian Affairs and Spatial Planning/National Land Agency (ATR/BPN), Shamy Ardian, roya is the process of cancelling the Mortgage Right. Matters regarding roya are at least regulated in Law No. 4 of 1996 on Mortgage Rights over Land and Related Objects. In general, the certificate release process at the Land Office takes around seven working days after the documents are declared complete. This provision refers to the applicable land service standards at the Ministry of Agrarian Affairs and Spatial Planning/National Land Agency (ATR/BPN). To apply for roya, applicants usually need to prepare several documents, including: According to the Ministry of ATR/BPN website, after the loan is paid off, the bank will provide a release letter to the creditor. Then, the creditor needs to go to the local Land Office (Kantah) to apply for the cancellation of the Mortgage Right on the land certificate and land book. For the public who will apply for the roya process with analogue certificate collateral and analogue Mortgage Right, the land certificate will be converted to an electronic certificate. The public can collect their certificate through the counter at the local Kantah. As information, if the Mortgage Right application is done electronically, the roya process will also be carried out electronically. Likewise, if the Mortgage Right was applied for before the electronic Mortgage Right system was in effect, the roya process is also manual at the Kantah. For further information, the public can consult the local Kantah or through the Ministry of ATR/BPN hotline 0811-1068-0000.
