House of Representatives' Commission III deems report by Andre Taulany's ex-wife against former domestic worker under Personal Data Protection Law inappropriate

Commission III of the House of Representatives believes that the use of the PDP Law in the case involving Hera, the former domestic worker of Erin Wartia, is inappropriate,” said the Chairman of Commission III of the House of Representatives, Habiburokhman, to reporters on Saturday (16/5/2026).

“The law should not be used excessively against ordinary people,” he added.

He stated that the use of the PDP Law in the case does not meet the requirements set out in the law. He also pointed out the nature of the disputed matter.

“Moreover, the disputed matter does not fall under the category of ‘personal data’ as defined in Law Number 27 of 2022 concerning Personal Data Protection,” he said.

He explained that the disputed matter in the case only consists of photos of the house and photos with the children, or ordinary documentation that does not contain a person’s personal identity. Therefore, the use of the PDP Law is not appropriate.

“The accusations against Hera are very inappropriate because personal data under the PDP Law is essentially related to personal identity such as ID cards, family cards, tax identification numbers, health data, bank accounts, and biometric data,” he explained.

He emphasized that the spirit of the formation of the PDP Law is to protect the public from the misuse of sensitive data and digital crime. He said that the PDP Law is not intended to expand the criminalization of ordinary people.

“Commission III of the House of Representatives is committed to protecting ordinary people so that they are not easily criminalized. The state must not be harsh on the weak and lenient on the strong. Law enforcement must prioritize justice, proportionality, and humanity,” he said.

Previously, as reported by detikHot, Erin officially took legal action by reporting Hera to the South Jakarta Metropolitan Police. Accompanied by her legal team, Erin charged the former domestic worker with the PDP Law.

This police report is a follow-up to Hera’s alleged dissemination of Erin’s family’s privacy through social media without permission. Erin’s side believes that this action has gone beyond the limits of reasonableness because it involves sensitive data that can threaten the family’s security.

“Our intention and purpose as Erin’s legal team today in coming to the South Jakarta Metropolitan Police is to report someone who we believe has gone far beyond the limits of reasonableness, by spreading private data and personal environment,” said Erin’s lawyer, Sunan Kalijaga, at the South Jakarta Metropolitan Police on Friday (8/5).
