House Commission III to Summon Mahfud MD Over Febrie Adriansyah Case

The House of Representatives’ Commission III Chairman, Habiburokhman, plans to invite former Coordinating Minister for Political, Legal, and Security Affairs Mahfud MD to seek his input regarding the validity of transferring the handling of the alleged corruption case of former Junior Attorney General for Special Crimes (Jampidsus) Febrie Adriansyah from the Indonesian National Police to the Attorney General’s Office. Mahfud MD previously issued sharp criticism that the mechanism for transferring the continuation of the investigation was flawed and violated the Criminal Procedure Code (KUHAP). “We must listen, including to input from Mr Mahfud, whether the case transfer is in accordance with the KUHAP or not. If according to Mr Mahfud it is not in accordance with the KUHAP, then perhaps we will also invite Mr Mahfud. We certainly must learn a lot from him scientifically,” said Habiburokhman in Jakarta on Monday. Habiburokhman stated that the process which occurred between the Police’s Corruption Eradication Corps (Kortas Tipikor) and the Attorney General’s Office last weekend was indeed not a phase two case transfer as regulated in criminal procedural law from investigator to public prosecutor. “Indeed, it was not a transfer as part of the criminal procedural law sequence from investigator to prosecutor. It was not. It was a handover of case handling from the institution named the Police, Bareskrim Polri, to the Prosecutor’s Office,” he admitted. The Gerindra Party politician explained there are two aspects being considered by the House. First, the commitment to thoroughly investigate this corruption scandal. Second, how to avoid friction or open clashes between law enforcement institutions. “Even if we talk at length that this is about rogue individuals and not about the institution, factually we cannot deny that friction could occur which ultimately becomes counterproductive to law enforcement,” he said. Responding to public doubts regarding the independence of the case handling by the Prosecutor’s Office, Habiburokhman said he has asked the Acting Jampidsus of the Attorney General’s Office, Rudi Margono, to form a new investigation team free from affiliations with former Jampidsus Febrie Adriansyah. “If possible, the team that will investigate this case should not be directly affiliated with the old Jampidsus. There is the Jamwas, there is Jamintel; a new, sterile team could be formed from there,” he stressed. Mahfud MD criticised the step taken by the Police’s Corruption Eradication Corps to hand over the continuation of the investigation into the alleged corruption case of former Jampidsus Febrie Adriansyah to the Attorney General’s Office. He stated that the mechanism of transferring an ongoing investigation is not recognised and is not justified under the Criminal Procedure Code. Mahfud admitted he was initially misled upon hearing the information at a press conference on Saturday, 11 July 2026. He thought the process was a routine case transfer that occurs when the dossier is complete, or P21. “But what happened was not a transfer in the sense of the Criminal Procedure Code, but rather a handover or transfer of the continuation of the investigation from the Police to the Prosecutor’s Office, because the suspect had apparently never been examined by the police. This mechanism of handing over or transferring the continuation of an investigation does not exist in our criminal procedural law and has never happened before,” he said.
