House Commission III Gathers Public Input to Refine Asset Forfeiture Bill

The House of Representatives (DPR) Commission III is actively gathering public input to refine the Asset Forfeiture Bill, which has been designated a top priority in the National Legislation Programme (Prolegnas). Commission III member Benny Utama emphasised the legislature’s commitment to completing the bill, noting that as an entirely new legal product in Indonesia, it requires careful deliberation to avoid legal flaws. He stated that the commission is intensively collecting feedback from various community elements, experts, and academics to ensure the law is robust upon implementation. Benny revealed that approximately 30 community groups and experts have already provided their thoughts to the DPR. One of the most critical points under discussion is the proposed application of a reverse burden of proof in the procedural law for asset forfeiture. While this concept has long been advocated, Benny acknowledged differing views and stressed the need for in-depth study to prevent potential human rights violations. The commission has requested that experts submit written drafts for thorough examination. Additionally, Benny highlighted public aspirations for the establishment of an independent supervisory body to oversee the management of assets seized by the state, aiming to prevent conflicts of interest. He suggested this body should ideally consist of external professionals, such as academics and auditors, recruited through an open selection process and required to report to the DPR annually.
