Hotel Sultan Land Execution Stated to Proceed Despite Appeal
JAKARTA, KOMPAS.com — Civil law expert Muhammad Ismak has stated that the Central Jakarta District Court’s (PN Jakarta Pusat) decision ordering execution of the Hotel Sultan land seizure must be enforced despite any appeal efforts, whether through cassation or judicial review.
“That does not prevent execution. The court must be able to immediately execute the decision. If that becomes the first-instance ruling,” said Ismak when confirmed by Kompas.com on Tuesday (16/3/2026).
Ismak noted that the defendant could attempt to prevent enforcement and argue that the first-instance court decision cannot be executed. However, he said that because of the immediate nature of the ruling, execution can still proceed.
“If that’s the core issue, this is actually a straightforward matter. It means the land owner wants the land back, whilst the tenant wants to remain there,” Ismak explained.
Ismak assessed that the first-instance decision with immediate effect had been carefully considered by the court. Consequently, if a different decision results from an appeal later, he predicted the outcome would not deviate from the previous ruling.
“I believe the essence of the case will not change—that the land will return to its owner,” he added.
The government has begun land measurement as part of the process of implementing the court decision regarding the land ownership status. The measurement was conducted on Monday (16/3/2026) as a follow-up to the constatation process carried out by the Central Jakarta District Court.
Constatation is the process of matching physical field data with administrative data contained in the court decision that has achieved final and binding legal force. This process is performed by the court clerk or bailiff to ensure the location, boundaries, and area of the disputed property correspond to the court’s ruling before execution is carried out.
The Director-General of the Gelora Bung Karno Complex Management Centre (PPKGBK), Rakhmadi Afif Kusumo, stated that constatation was conducted to confirm that the boundaries of the land currently used for Hotel Sultan match the application by PPKGBK and Indonesia’s State Secretariat Ministry regarding state asset status in Block 15 of the GBK area.
According to him, the constatation carried out by PN Jakarta Pusat focused on Block 15.
