We, O.C. Kaligis and Associates, having the address at Jl. Majapahit Permai 18-20, Kompleks Majapahit Permai Blok B. 122- 123, Central Jakarta, based on the power of attorney, act for and on behalf Honoris Hospital, which is representative by Welly Chandra as a Director, domicile at Honoris Raya, Kav. 6, Kota Modern, Tangerang.
Whereas, the daily of The Jakarta Post on Tuesday, July 26, 2005, page 8, contained a report titled Honoris Hospital reported to Police and on Monday, Aug. 1, 2005, page 9, contained a report titled Daughter reports medical staff to police after mother left in coma. Such report contained a misleading information and caused damages to our client. Therefore, we file hereby our right to respond against the daily of The Jakarta Post which has damaged our client's images as follows: * Whereas, Mrs. Cicilia Djarwati, 70 years old, before undergoing a cataract surgery in the waiting hall was apparently suffering from heart attack which has caused her unconscious so far and in fact the cataract surgery has not been served. * Whereas, the information that was written in the daily newspaper, The Jakarta Post on Tuesday, July 26, 2005, page 8, which states that "They said that my mother was throwing up and fell unconscious after they gave her medication for her eye just before the surgery", is in fact not true, because the doctor has never told Retno Pancawati (family of Cicilia Djarwati) that the cause of vomiting and unconsciousness experienced by Mrs. Cicilia Djarwati was eye drops given by the doctor before the cataract surgery was performed. * Whereas, eye drops which were served to Mrs. Cicilia Djarwati is the same kind of eye drops which are commonly served before any cataract surgery, it is pursuant to normal procedure. * Whereas, by the contained title Honoris Hospital reported to Police and Daughter reports medical staff to police after mother left in coma, you have caused damages to our client as such title shall upset people to come to our client for medical treatment. Your editorial staff should check the information to our client before the title was printed.
Based on entitle 5 paragraph (2) Rule of Law Number 40/1999, editor of The Jakarta Post daily have the obligation to reply to our right in order to come up with a balance of news release.
If our right of response is not published by the daily newspaper, The Jakarta Post, then we will not send you our right of response again, but instead we will not hesitate to resort to legal action.
