Hercules Faction Reveals Evidence of Land Ownership in Tanah Abang

The faction of the Chairman of the Gerakan Rakyat Indonesia Bersatu Jaya (GRIB Jaya), Rosario de Marshal alias Hercules, has refuted claims by PT Kereta Api Indonesia (Persero) regarding the ownership status of a plot of land in Tanah Abang. Wilson Collin, Deputy Head of the Legal and Advocacy Division of GRIB Jaya and the Heirs’ Expert, expressed regret over statements deemed tendentious from Minister of Transportation Maruarar Sirait and KAI President Director Boby Rasyidin concerning the Tanah Abang land dispute. “I am only focusing on the minister, because the minister is tendentious; he doesn’t know the facts of the matter, yet he says the state should not be afraid, the state should not lose. I am also criticising its director (KAI’s President Director),” Collin stated during a live broadcast on GRIB Jaya’s official YouTube channel on Tuesday (14/4/2026). Previously, KAI’s President Director had claimed that company land around Tanah Abang Station was controlled by mass organisations. However, that claim is considered legally flawed. Collin emphasised that there has never been any release of rights or compensation from the state to the original owners by PT KAI. GRIB Jaya’s legal team then highlighted the 2008 Land Management Rights Certificate (HPL) in the name of PT KAI, which is deemed to contain juridical defects or error in objecto. Based on the legal principle of prior tempore potior jure, rights that arise first (eigendom from 1923) hold a stronger position than rights that emerge later (issued in 2008) without a valid process. “It cannot be justified if rights that arose in 2008 override rights that have existed since 1923 without a valid legal process,” Collin explained.
