Helmet Theft at GBK: Victim Has Legal Basis to Demand Compensation
Security in public parking areas has come under scrutiny again after a motorcyclist, Surya Aditya Hasbi, shared his bitter experience of losing his helmet in the Gelora Bung Karno (GBK) area, Senayan, Central Jakarta.
Through a post on social media platform Threads on Wednesday (15/4/2026), Surya stated that the incident occurred in the parking lot of Building A, right in front of Istora GBK around 9:00 PM WIB.
When confirmed by Kompas.com, Surya said he had parked his Yamaha NMAX and secured the helmet by hanging it on the hook under the motorcycle seat.
However, after exercising, he found the helmet missing.
Officers claimed that access to CCTV footage is the authority of the GBK management, not the parking operator.
Furthermore, the management stated that losses of items in the area are not their responsibility.
In response, Rio Octaviano, Chairman of the Indonesia Parking Association (IPA), emphasised that legally, parking operators cannot simply wash their hands of losses experienced by service users.
Rio explained that the victim has a strong legal basis to demand compensation.
The procedure for checking CCTV should be part of their internal coordination to meet insurance requirements.
“The victim can demand from the parking operator to compensate for the loss. Usually, after receiving the demand, they must coordinate with local officers to access CCTV as evidence. Because insurance requires proof,” said Rio.
Furthermore, Rio reminded that the notice “All losses are not the responsibility of the management” often displayed on parking tickets is actually a standard clause that is prohibited.
“All losses of items or damage outside the responsibility of the parking management falls under a standard clause, and that can be criminalised,” he said.
For the public experiencing similar incidents, Rio suggested keeping the parking ticket as valid proof that the vehicle was under the operator’s supervision.
If the management continues to complicate the compensation process, victims are advised to report to the police or complain to the Directorate of Consumer Protection and Market Order of the Ministry of Trade.
“The main point is to demand accountability from the parking operator to compensate for the loss. The incident must occur within the parking area and they must have proof of being there,” said Rio.
