Hearing on Gibran's Educational Qualifications to Continue Tonight, Focus on Petitioner's Evidence
The Constitutional Court (MK) will hold a follow-up hearing regarding the dispute over the results of the 2024 Presidential and Vice-Presidential General Election (PHPU). The hearing, which involves a lawsuit seeking the disqualification of Gibran Rakabuming Raka due to alleged failure to meet the educational requirements for the Vice-Presidential candidate, is scheduled for tonight.
According to the official Constitutional Court website on Wednesday (30/09/202le), the hearing is scheduled to take place today at 19:00 WIB. The agenda for this session is the presentation of evidence by the petitioners.
“Presentation of Petitioner’s evidence (hearing testimony from Experts and/or Petitioner’s Witnesses and the validation of Petitioner’s additional evidence),” the MK official website stated.
The lawsuit was filed by former Deputy Minister of Law and Human Rights, Denny Indrayana, alongside 11 other petitioners. The application was submitted on 10 September 2026 and officially registered by the MK on 17 September 2026, under case number 01/PHPU.PRES-XXIV/2026.
The preliminary examination of the application was previously held at the MK on Monday (21/09).
The respondents in this lawsuit are the General Elections Commission (KPU) RI, with the General Elections Supervisory Agency (Bawaslu) RI acting as a related party. There are 12 petitioners in this lawsuit, including Brahma Aryana, Ansufri ID Sambo, Denny Indrayana, Fachrul Razi, Tyasno Sudarto, Slamet Soebijanto, Hanafie Asnan, Soenarko MD, drg. Moeryono, H.M. Subhan, Bonatua Silalahi, and Dra. Tiurma M.S. Sihombing.
The petitioners argue that the alleged failure to meet Gibran’s educational requirements only recently came to light and suggest that such information was suppressed. The petitioners stated that if the trial evidence proves Gibran meets the educational requirements, the Court may affirm the validity of his candidacy. Conversely, if the evidence shows he does not meet the requirements, the Court must impose disqualification.
“The Petitioners only request a fair opportunity so that the legal truth regarding the fulfilment of Gibrante Rakabuming Raka’s educational requirements at the time of his designation as a vice-presidential candidate can be tested through a trial of evidence that is open, impartial, transparent, and accountable,” they requested.
The complete petition includes requests to grant the petitioners’ application in its entirety, declare the educational requirements under Law Number 7 of 2017 as mandatory, and disqualify Gibran Rakabuming Raka. Furthermore, the petitioners seek to nullify the KPU’s decisions regarding his designation and the subsequent inauguration, requesting that the People’s Consultative Assembly (MPR) hold a session to elect a vice president from two candidates proposed by the President within 60 days of the ruling.
