JAKARTA, KOMPAS.com - Chairman of Commission III of the House of Representatives, Habiburokhman, has revealed that several parties are attempting to weaken the position of the Indonesian National Police (Polri) in the discussions on revising the Criminal Procedure Code (KUHAP).

“The position of Polri in the KUHAP was also the subject of much effort during its drafting to weaken it,” said Habiburokhman at the Seminar for S1 Students of STIK Lemdiklat Polri on Monday (13/4/2026).

Habiburokhman explained that one prominent issue was the control of cases within the criminal justice system.

He mentioned that several parties have questioned Polri’s role in the investigation process.

“There are challenges to situations where the police are somewhat subordinate to other institutions in investigations,” stated Habiburokhman.

However, Commission III of the House of Representatives considers the current division of authority to be ideal and in need of preservation.

Additionally, another proposal that emerged was transferring the authority for detention from Polri investigators to the Chief of the District Court.

“We see that if this is implemented, it would not only damage the Polri institution but also weaken the state’s role in ensuring security and public order,” he explained.

He stated that despite pressure from various parties, Commission III of the House of Representatives ultimately succeeded in maintaining two key principles: Polri’s maximal authority in investigations and detention powers.

This Gerindra Party politician also affirmed that Polri’s position as the primary investigator remains upheld in the KUHAP discussions.

“If we refer to Article 30 paragraph 4, the law enforcers are only the police, sir. Therefore, it is reasonable that Polri is called the primary investigator,” said Habiburokhman.

Nevertheless, he opened the door for technical investigators from other institutions, such as in the financial sector, to assist in uncovering specific criminal acts.

On the other hand, Habiburokhman also highlighted the importance of integrity and openness in law enforcement institutions.

According to him, transparency is key to maintaining public trust and ensuring that violations are committed by individuals, not the institution.

“The most important thing is how the institution responds to rogue elements. And I must say that Polri is the institution that provides the best response to violations committed by its rogue members,” said Habiburokhman.
