Habiburokhman Grateful that ABK Fandi Ramadhan Was Not Sentenced to Death

National News - The chair of Commission III of the DPR, Habiburokhman, said he was grateful that Sea Dragon crew member Fandi Ramadhan was not sentenced to death. The Batam District Court panel sentenced the defendant to five years in prison for a narcotics smuggling case. ‘The panel understands that under Article 98 of the new KUHAP, the death penalty is not a primary penalty and is a last resort,’ Habiburokhman said. He added that the court’s approach reflects the paradigm in the new KUHP which prioritises substantive and rehabilitative justice. ‘We respect the stance of the defendant or their legal representative who argue for acquittal, but we cannot intervene technically in the case,’ he said. Habiburokhman emphasised that his side would still summon investigators and prosecutors to inquire about the fulfilment of suspects’ or convicts’ rights from the time the case was investigated through to the verdict.
