Fresh Out of Parole, Lukas Enembe's Lawyer Files Review in Obstruction of Investigation Case

JAKARTA, KOMPAS.com - The lawyer for the late Governor of Papua, Lukas Enembe, Stefanus Roy Rening, has filed a judicial review (PK) in the obstruction of investigation case within the bribery and gratification matter that ensnared Lukas.

“So, I feel that constitutionally, my right to fight back through the legal remedy of PK can be pursued,” said Roy Rening, when providing a statement at the Corruption Court at the Central Jakarta District Court, on Monday (6/4/2026).

Roy filed this PK application shortly after being released on parole following his 4.5-year prison sentence for obstructing the investigation in Lukas’s case.

Roy admitted that he was only released on parole in November 2025.

In filing this PK application, Roy submitted the Constitutional Court decision number 71/PUU-XXIII/2025, which was decided in early March 2026.

This Constitutional Court decision eliminates the phrase “directly or indirectly” in Article 21 of the Law on the Eradication of Criminal Acts of Corruption (Tipikor).

“So, we are pursuing the judicial review route based on the Constitutional Court decision, where in our view, the basis for prosecuting, charging, and convicting our colleague Roy was based on a law article that was declared unconstitutional by the Constitutional Court,” said Roy’s lawyer, Irianto Subiakto.

In addition, Roy’s side also sees a judicial error by the judge when deciding his case, both at the appeal and cassation levels.

“So, it is true that the decision (Roy’s verdict) was based on regulations that are unconstitutional. Therefore, Roy must be declared not guilty and have his good name restored,” said Irianto.
