Four TNI Members Who Threw Acid on Andrie Yunus Charged Only with Assault
Four TNI soldiers suspected of throwing acid on Andrie Yunus, Deputy Coordinator of KontraS, have been charged under Article 467 of the new Criminal Code regarding planned assault.
“The suspects are charged under Article 467 of Criminal Code Law Number 1 of 2023. There are paragraphs 1 and 2, where the penalties are already stipulated, some four years and some seven years,” said TNI Puspom Commander Major General Yusri Nuryanto during a press conference at TNI Headquarters, Cilangkap, East Jakarta, on Wednesday (18/3).
Article 467 in the new Criminal Code regulates assault with prior planning. The full text of Article 467 paragraphs 1 and 2 of the new Criminal Code is as follows:
Any person who commits assault with prior planning shall be sentenced to imprisonment for a maximum of 4 (four) years.
If the act referred to in paragraph (1) results in serious injury, the perpetrator shall be sentenced to imprisonment for a maximum of 7 (seven) years.
This charge contradicts the stance of the Civil Coalition, including KontraS. The Civil Coalition views the acid-throwing terror against Andrie Yunus as an attempted premeditated murder.
In the new Criminal Code, attempted premeditated murder is regulated under Article 459 with a maximum penalty of 20 years imprisonment. The text of Article 459 of the Criminal Code is as follows:
Any person who with prior planning deprives another person of their life shall be punished for premeditated murder with the death penalty or life imprisonment or imprisonment for a maximum of 20 (twenty) years.
TNI Headquarters has arrested the four soldier suspects who threw acid on Andrie Yunus. The four are initialled:
“Regarding the four alleged suspects earlier, the first is initial NDP, the second initial SL, the third initial BHW, the fourth initial ES,” said Yusri.
