Former Police Officer Convicted in Brigadier Nurhadi Death Case Files Cassation
Former Police Lieutenant Colonel I Made Yogi Purusa Utama, the defendant in the case involving the death of Brigadier Muhammad Nurhadi at a Gili Trawangan inn, has filed for cassation to the Supreme Court via the Mataram District Court.
Suhartono, the legal counsel for the defendant, confirmed the legal move on Monday, stating that the defendant’s decision is based on the belief that the appellate court’s ruling was not properly grounded in the facts presented during the initial trial. The High Court of West Nusa Tenggara (NTB) modified the sentence, increasing the prison term from 14 years at the first-instance court to 15 years.
The indictment maintains that Made Yogi is guilty of murder and obstruction of justice, specifically the obstruction of crime disclosure or the destruction of evidence, as outlined in the first and second counts of the public prosecutor’s indictment. These charges relate to criminal elements stipulated under Article 458 paragraph (1) of Law Number 1 of 2023 (the New Criminal Code) and Article 221 paragraph (1) of the Criminal Code in conjunction with Article 20 of the same law.
In response to the filing, the spokesperson for the West Nusa Tenggara High Prosecutor’s Office, Harun Al Rasyid, stated that the prosecution is preparing a counter-memorandum for the cassation. He noted that while they will respond to Made Yogi’s appeal, the prosecution has also filed its own cassation regarding another defendant, Aris Chandra, due to concerns that the current sentencing does not sufficiently reflect the requirements of justice.
