The two defendants sentenced are former Head of the Technical Implementation Unit for Gili Trawangan Services (UPTD) and Air (Tramena), Mawardi Khairi, and Director of PT Ombak Buena Gili, Alpin Agustin. In addition to imprisonment, both defendants were also fined Rp 50 million. If the fine is not paid, it will be replaced with corporal punishment. “With the provision that if the fine is not paid, it will be replaced with 50 days’ imprisonment,” he said. The judge stated that both defendants were proven to have violated Article 3 in conjunction with Article 18 of Law No. 31 of 1999 on the Eradication of Corruption Crimes as amended by Law No. 20 of 2001 on Amendments to Law No. 31 of 1999 on the Eradication of Corruption Crimes in conjunction with Article 55 Paragraph (1) first of the Criminal Code in conjunction with Article 65 Paragraph (1) of the Criminal Code. “We declare the defendant proven legally and convincingly guilty of committing the crime of corruption as charged subsidiarily,” he said. Lighter Than Prosecutors’ Demands The sentence for both defendants is lighter than the prosecutors’ demands. Previously, the prosecutor demanded 18 months’ imprisonment and a Rp 50 million fine subsidiary to three months’ imprisonment for Mawardi Khairi. Meanwhile, Alpin Agustin was demanded 15 months’ imprisonment and a Rp 50 million fine subsidiary to three months’ imprisonment. Regarding the judge’s decision, both defendants stated they accepted it. “We accept, Your Honour,” the two defendants responded in turn. In this case, Mawardi Khairi and Alpin Agustin were defendants along with a businesswoman named Ida Adnawati. For that defendant, the judge postponed the reading of the verdict because the file was not complete. “The verdict hearing will be held on Monday (11/5),” the judge said. The case that ensnared the three was investigated since 2021, after PT Gili Trawangan Indah (GTI) terminated its contract with Pemprov NTB in managing the 65-hectare tourism area. In the investigation process, investigators from the NTB Attorney General’s Office found state losses of Rp 1.4 billion.
