Former Bobby Nasution Aide Indicted for 5 Years and 6 Months’ Imprisonment in Corruption Case

Former Head of the North Sumatra Public Works and Public Housing Office (PUPR) Topan Obaja Putra Ginting has been indicted to five years and six months’ prison. The former aide to Governor Bobby Nasution was found guilty of corruption in funds allocated for a road construction project in North Sumatra.

In the same proceedings, Rasuli Efendi Siregar, the former Head of UPTD Gunung Tua in the North Sumatra PUPR, was indicted to four years’ imprisonment and a fine of Rp200 million subsiding 80 days.

The KPK prosecutors also imposed an additional penalty on Topan in the form of restitution for state losses amounting to Rp50 million, subsiding one year in prison. Rasuli was subjected to an additional penalty of Rp250 million. However, that money has been returned by Rasuli to the KPK.

Both defendants were deemed guilty of committing the crime of corruption as set out in the first indictment, Article 12 letter a of Law Number 20 of 2001 on the Eradication of Corruption, in conjunction with Article 55 Paragraph (1) Subsection 1 of the Penal Code.

Among the aggravating factors, the acts did not support the government’s anti-corruption efforts. Conversely, the defendant Topan did not admit his actions nor express remorse.

For mitigating factors, the defendant has no prior convictions and has dependants in his care, the prosecutor noted.

In the indictment, Topan Obaja Ginting received Rp50,000,000 and a commitment fee of 4% of the contract value. Rasuli Efendi Siregar had received Rp50,000,000 and a commitment fee of 1% of the contract value.

The money was provided by Muhammad Akhirun Piliang alias Kirun, the President Director of PT Dalihan Na Tolu Grup, and Muhammad Rayhan Dulasmi Piliang alias Rayhan, the President Director of PT Rona Na Mora.

The money was given so that Topan Obaja Putra Ginting, via Rasuli Efendi Siregar, would arrange the bidding process using the e-catalog method to appoint PT Dalihan Na Tolu Grup and PT Rona Na Mora to undertake road works for the North Sumatra PUPR.

The events began when Rasuli outlined the road segments already included in the 2025 budget and also the roads requiring attention, namely the Sipiongot - Labuhan Batu provincial road and the Hutaimbaru - Sipiongot provincial road in Padang Lawas Utara Regency.

However, these works were not yet funded in the 2025 provincial Revenue and Expenditure Budget (APBD) of North Sumatra. On 12 March 2025, Topan submitted a proposal for Budget Shift III to the North Sumatra PUPR APBD for 2025, as per letter No. 900/DPUPR-UM/1300 addressed to the Chairman of the Regional Government Budget Committee (TAPD).

There are package works: Provincial Road Structure Improvement on the Sipiongot - Bts Labuhan Batu section with a budget ceiling of Rp96,000,000,000 and Provincial Road Structure Improvement on the Hutaimbaru - Sipiongot section in Padang Lawas Utara with a total budget ceiling of Rp69,800,000,000 for the Gunung Tua UPTD PUPR.

Later, in a TAPD team discussion, the proposal was approved and subsequently codified in Governor Regulation Number 16 of 2025 on the Third Amendment to Governor Regulation North Sumatra Number 37 of 2024 on the Explanation of the North Sumatra Regional Revenue and Expenditure Budget for 2025 (TA 2025) on 13 March 2025.

However, the two road segments were not linked to disaster relief or urgent infrastructure management. In addition, the North Sumatra PUPR did not have planning documents to justify the budget ceiling.

On 19 March 2025, Topan Obaja together with Rasuli Efendi Siregar and Yasir Ahmadi (Chief of Police for South Tapanuli) conducted a survey to determine the road conditions in person. Topan also asked Yasir Ahmadi who would be capable of carrying out the road works, who had complete equipment, and who owned an Asphalt Mixing Plant (AMP) in the Gunung Tua area.

Yasir Ahmadi and Rasuli Efendi Siregar replied that Muhammad Akhirun Piliang possessed an AMP in the Gunung Tua area. On 22 April 2025, Topan, in collaboration with Governor Bobby Nasution, Yasir Ahmadi, Muhammad Akhirun Piliang, and Muhammad Rayhan Dulasmi Piliang (Rayhan) conducted a survey of the Sipiongot - Labuhan Batu road and the Sipiongot - Hutaimbaru road.

Yet Topan had not yet ratified the Budget Execution Shift Document (DPPA) for the North Sumatra PUPR and had not incorporated the survey results into the technical planning documents for the road works.

On 30 April 2025, Muhammad Rayhan sent Rp20 million to Rasuli Efendi Siregar to assist PT Rona Na Mora and PT Dalihan Na Tolu Grup in securing the contract or execution of the road-structure improvement works for the Sipiongot - Batas Labuhan Batu and Hutaimbaru-Sipiongot sections.

On 21 May 2025, Topan followed up the 2025 APBD changes by issuing the Budget Implementation Shifting Document for the PUPR Sumut.

Subsequently, Topan offered a commitment fee with a total equal to 5% of the contract value, in line with the customary practice when Muhammad Akhirun Piliang secured a project within the PUPR Sumut. The breakdown was 4% for Topan and 1% for Rasuli Efendi Siregar.

Under Topan Obaja Ginting’s orders, Rasuli Efendi Siregar ordered Ryan Muhammad, a Supervising Staff at the Gunung Tua UPTD, and Bobby Dwi, an outsourcing staff at the Gunung Tua UPTD, to ensure that PT Dalihan Na Tolu Grup and PT Rona Na Mora were the winning bidders.

The events began when Rasuli presented the road segments that had been funded for 2025 and identified roads that required attention. However, both segments did not yet have budget allocations.
