Following Diploma Ruling, Gibran Reported to Bareskrim
The Vice President of the Republic of Indonesia, Gibran Rakabuming Raka, and the Ministry of Primary and Secondary Education (Kemendikdasmen) have been reported to the National Police Criminal Investigation Agency (Bareskim Polri). The report was filed by the Advocacy Team for the Enforcement of Ethics, Morals, and National Integrity regarding the alleged criminal act of forging an educational equivalence certificate (suket) used during the 2024 Presidential Election registration.
“We were directed to the Public Complaints division (Dumas), and we have received an acknowledgement of receipt regarding our police report, which concerns the alleged criminal act of forging documents and/or using documents containing untrue information or forgeries in relation to fulfilling the requirements for candidacy as the Vice President of the Republic of Indonesia in 2024,” said the complainant’s legal counsel, Ahmad Khozinudin, at Bareskrim Polri, South Jakarta, on Wednesday (7/10/2026).
According to Khozinudin, the disputed object is the certificate issued by the Ministry of Education and Culture in August 2019, which served as the document for Gibran’s educational equivalence to Senior High School (SMA).
“The reported object is the certificate. The reported articles are Article 391, paragraphs 1 and 2. Paragraph 1 relates to the issuer, namely the Ministry of Primary and Secondary Education, while paragraph 2 relates to the user of the certificate, namely Gibran,” he explained.
This complaint was filed following a Constitutional Court (MK) ruling regarding Gibran’s educational requirements. Khozinudin stated that although the lawsuit was not accepted, the judges’ legal considerations serve as evidence that Gibran does not possess a high school equivalent diploma.
“The Court has considered, examined, and reviewed data, facts, and evidence in court that Mr Gibran Rakabuming Raka does not possess a high school, vocational school, or Madrasah Aliyah diploma,” said Khozinudin.
Khozinudin further discussed the Constitutional Court judges’ considerations, which linked the certificate to the Ministry of Education and Culture Regulation Number 29 of 2014 regarding Diploma Equivalence. According to Khozinudin, documents eligible for equivalence should be diplomas, graduation certificates, or foreign diplomas.
“It turns out Gibran does not possess any of the three objects subject to equivalence. Gibran does not have a graduation certificate, diploma, or diploma from abroad. The only basis used was the Grade 12 from Insearch UTS Sydney, Australia,” he explained.
Khozinudin added that if the Constitutional Court could not request direct testimony from Gibran, he hopes the National Police investigators can seek clarification from the Vice President.
In addition to criminal proceedings, Khozinudin stated that his party will pursue constitutional channels through the House of Representatives (DPR). They intend to push for a Joint Session of the People’s Consultative Assembly (MPR) regarding the fulfilment of requirements for the office of Vice President.
“We will also pursue a constitutional path through the DPR RI to report a constitutional violation, namely that the requirements to become Vice President have proven to no longer be met,” said Khozinudin.
Separately, nine Constitutional Court judges have been reported to the Constitutional Court Ethics Council (MKMK) regarding alleged ethical violations in handling the dispute over the Vice President’s diploma. The nine judges were reported by the Chairman of the Indonesian Student Forum (Formasi), Pian Andreo Halomoan Manurung.
Piand assessed that the Constitutional Court judges violated the principle of independence.
