Banda Aceh (ANTARA) - The panel of judges at the Corruption Court within the Banda Aceh District Court has sentenced five defendants in a local tax corruption case at the West Aceh Regency Government to a total of 10 years in prison.

The verdict was delivered by the panel, chaired by Irwandi and accompanied by Heri Alfian and R Deddy Haryanto as member judges, during the trial at the Corruption Court of the Banda Aceh District Court in Banda Aceh on Friday.

The defendants are M Husin, Acting Head of the West Aceh Regency BPKD in 2018-2019, and Zulyadi, Acting Head of the West Aceh Regency BPKD in 2019-2020.

Additionally, Jani Janan, Acting Head of the West Aceh Regency BPKD in 2020-2021, Elvia Hasmaneta, Head of the Revenue Division of the West Aceh Regency BPKD in 2018-2019, and Said Fachdian, Head of the Revenue Division of the West Aceh Regency BPKD in 2019-2022.

The defendants attended the trial accompanied by their respective legal counsel teams. The proceedings were also attended by Public Prosecutor Ardiansyah Girsang and colleagues from the West Aceh District Prosecutor’s Office.

For defendant M Husin, the panel imposed an additional sentence of repaying state losses amounting to Rp22 million. If the defendant fails to pay, he will face one month in prison.

The panel also sentenced defendant Zulyadi to repay state losses of Rp227.7 million, converted from Rp180 million already returned. If the defendant fails to pay the remaining state losses, he will face one month in prison.

For defendant Jani Janan, the panel imposed an additional sentence of repaying state losses of Rp14.13 million. If the defendant fails to pay, he will face one month in prison.

Meanwhile, for defendants Elvia Hasmaneta and Said Fachdian, the panel did not impose additional sentences for repaying state losses.

Regarding the panel’s decision, the defendants and their legal counsel stated they would consider an appeal. The public prosecutors also stated they would consider an appeal. The panel granted seven days for the parties to deliberate.

Previously, Public Prosecutor Ardiansyah Girsang and colleagues had charged the defendants with corruption in the intensive management of local taxes at the West Aceh Regency BPKD from 2018 to 2022.

The intensive management of local tax collection amounted to more than Rp4.4 billion. These local taxes were sourced from, among others, street lighting taxes, hotel and restaurant taxes, and others.

However, in its management, deviations occurred, causing state financial losses of Rp3.58 billion. From the total state losses, Rp624.46 million has been returned during the investigation.
