Fines Imposed on Companies for Dumping Waste at Illegal Cilincing Dumpsite

A growing mound of waste in the Cilincing area of North Jakarta has drawn sharp public attention, prompting sanctions against companies found to be dumping rubbish at an illegal disposal site. Governor of DKI Jakarta Pramono Anung has ordered the private party managing the site to be shut down and penalised, and has also requested that the violating companies be announced to the public. “I have also received a report that the manager of the illegal dumpsite in Nagrak, Cilincing, is a private entity. And it has no connection to the DKI Jakarta Provincial Government,” Pramono said at Jakarta City Hall on Tuesday. Pramono stated that the waste piled up at the location originated from the hotel, restaurant, and café sector. According to him, the management was paid to transport the waste but instead disposed of it carelessly. He confirmed the location is not an official landfill belonging to the DKI Jakarta Provincial Government. On the same day, the DKI Jakarta Environment Agency announced the first company to be sanctioned. At least five companies have been fined by the DKI Jakarta Provincial Government. The sanctions were imposed because the five waste transport service providers were proven to be operating not in accordance with their permits. The first company sanctioned was PT Sinar Berdikari Cemerlang Idaman. In addition to a fine of Rp10 million, the DKI Jakarta Environment Agency also issued a first written warning to the company. SBCI admitted that the vehicle recorded in the video belonged to their fleet. The investigation found employee residences and a parking area for the company’s waste transport vehicles near the disposal site. Subsequently, the DKI Jakarta Environment Agency sanctioned four more companies: PT Mapanji Kamila Graha, PT Samhana Indah, PT Arie Karya Utama, and PT Pradana Sukses Prima. The sanctions were imposed after the companies were summoned and examined. “The Governor’s directive is very firm. The practice of illegal waste dumping cannot be tolerated. Four companies have been examined and dealt with today, but the handling does not stop here,” said Head of the DKI Jakarta Environment Agency Dudi Gardesi in a statement on Friday. The fines are based on Article 131 paragraph (1) of Regional Regulation Number 3 of 2013 as amended by Regional Regulation Number 4 of 2019. Meanwhile, the First Written Warning was given based on Article 21 paragraph (1) letter a of DKI Jakarta Governor Regulation Number 102 of 2021 concerning Waste Management Obligations in Areas and Companies. The DKI Jakarta Environment Agency will trace the waste management chain, from the transport vehicles and service provider companies to the source of the waste and the parties using the transport services. Waste transport companies are required to ensure that the waste they carry is disposed of at a location that complies with regulations and to be accountable for the waste stream they handle. “If activities are not in accordance with the permit and waste is dumped at an illegal site, we will take action. There is no room for such practices in Jakarta,” Dudi stressed. Head of the Supervision and Legal Compliance Division at the DKI Jakarta Environment Agency, Helmy Zulhidayat, explained that the four companies actually already held Business Licences for Transport Services in the Sanitation Sector. Based on these permits, waste from the businesses and activities that are their clients should have been transported to the Bantargebang Integrated Waste Treatment Facility, but was instead dumped at a location not in accordance with regulations, including the illegal Cilincing dumpsite. “For these violations, we imposed administrative sanctions in the form of a coercive payment of Rp10 million and a First Written Warning,” Helmy said. The DKI Jakarta Environment Agency will continue to identify the transport companies, the source of the waste, and the parties using transport services to the illegal dumpsite. “We are not stopping with these four companies. Other vehicles will be identified and traced until the matter is resolved,” he stated.
