Febrie pretrial hearing underway, expert opens possibility of new investigation order

Jakarta (ANTARA) - Trisakti University criminal law expert Abdul Fickar Hadjar has said the Attorney General’s Office can issue a new investigation order (sprindik) in the case of Febrie Adriansyah if the previous order is annulled through a pretrial hearing.

“If sprindik one is annulled, then it can be done with a new sprindik,” Fickar said in a statement received in Jakarta on Friday.

According to him, the issuance of a new sprindik is possible if investigators still have sufficient supporting evidence to continue handling the case.

The statement was made in relation to the pretrial motion filed by former Junior Attorney General for Special Crimes (Jampidsus) Febrie Adriansyah against the legal process over alleged corruption and money laundering (TPPU) that has ensnared him.

After the pretrial hearing at the South Jakarta District Court on Tuesday (18/8), Febrie’s advocate, Febri Diansyah, said there were 30 alleged procedural violations in the legal process against his client.

In addition, Febrie’s side is questioning the process of search, seizure, and the naming of a suspect without examining the prospective suspect, the travel ban, and the continued handling of the case at the Attorney General’s Office.

“So from several of these aspects, we have identified indications of 30 violations of procedural law and the principles of due process of law. These 30 will of course be tested further,” Febri said.

Febri said his side will present a number of experts in the next hearing to examine the alleged violations.

Nevertheless, his side still respects the single judge presiding over the pretrial hearing.

Febrie has filed two pretrial motions at the South Jakarta District Court.

The first pretrial motion is registered under case number 134/Pid.Pra/2026/PN JKT.SEL with the main object being the validity of the forced seizure effort. In the motion, Febrie’s side is also questioning a number of legal actions, including the issuance of the sprindik, the search, the suspect designation, and the travel ban.

The respondents in the case are the Special Criminal Investigation Directorate of the Polda Metro Jaya, the Corruption Eradication Corps of the National Police, and the Investigation Directorate of the Junior Attorney General for Special Crimes.

Meanwhile, the second pretrial motion is registered under case number 135/Pid.Pra/2026/PN JKT.SEL which examines the validity of Febrie’s designation as a suspect by the Attorney General’s Office.

Meanwhile, the National Police previously named Febrie as a suspect in alleged corruption and money laundering in the handling of the PT Asabri case for the 2020–2024 period. Don Ritto, a private party, is also a suspect in alleged money laundering in the same case.
