Febrie Adriansyah Files Second Pretrial Motion Challenging Investigation and Suspect Status
Former Deputy Attorney General for Special Crimes (Jampidsus) Febrie Adriansyah has filed a second pretrial motion at the South Jakarta District Court (PN Jaksel). The pretrial motion challenges the investigation and the designation of suspect status against Febrie.
The hearing was held in the Main Courtroom of PN Jaksel, Ragunan, South Jakarta, on Wednesday (19/8/2026). The pretrial motion is registered under case number 135/Pid.Pra/2026/PB JKT.SEL, with the Attorney General cq the Deputy Attorney General for Special Crimes at the Attorney General’s Office as the Respondent.
Febrie’s lawyer and the Respondent were present at today’s hearing. Febrie’s lawyer has read out the pretrial petition, so the hearing will be continued with the agenda of the Respondent’s response and the submission of documentary evidence by Febrie on Thursday (20/8) tomorrow.
“Today’s hearing is declared concluded and will be adjourned until Thursday tomorrow, 20 August 2026, with the opportunity to submit a response as well as documentary evidence from the petitioner’s legal counsel. The parties remain present, the hearing is concluded and the session is closed,” said single judge Richard Edwin Basoeki.
The following is the complete petition of Febrie Adriansyah’s second pretrial motion:
To declare that the Petitioner’s Pretrial Motion is accepted and granted in its entirety;
To declare invalid and without binding legal force with all legal consequences the Determination Letter Number: TAP-03/F/Fd.2/07/2026, dated 24 July 2026, concerning the Determination of Suspect in the name of Febrie Adriansyah, issued by the Respondent;
To declare invalid and without binding legal force with all legal consequences the Detention Order Number: PRIN-43/F/Fd.2/07/2026, dated 24 July 2026, against the Petitioner, issued by the Respondent;
To order the Respondent to immediately release and discharge the Petitioner from the State Detention Centre, Class I Detention Centre of East Jakarta, KPK State Detention Centre Branch, Jalan Kuningan Persada Kav. 4, South Jakarta;
To declare invalid and without binding legal force with all legal consequences the Investigation Order of the Deputy Attorney General for Special Crimes Number: Print-03/F.2/Fd.2/07/2026 dated 20 July 2026, issued by the Respondent;
To order the Respondent to discontinue the investigation based on the Investigation Order of the Deputy Attorney General for Special Crimes Number: Print-03/F.2/Fd.2/07/2026 dated 20 July 2026;
To declare that the entire series of follow-up actions by the Respondent against the Petitioner or the Petitioner’s family issued based on the Investigation Order of the Deputy Attorney General for Special Crimes Number: Print-03/F.2/Fd.2/07/2026 dated 20 July 2026 are invalid and without binding legal force with all legal consequences;
To declare invalid all further decisions or determinations or actions issued by the Respondent relating to the investigation and determination of suspect against the Petitioner, including the Notice of Commencement of Investigation issued by the Respondent;
To restore all legal rights of the Petitioner against the actions that have been taken by the Respondent;
To charge the case costs according to law.

For information, Febrie has also filed a pretrial motion with the object of the petition being the legality of the implementation of seizure measures. This pretrial motion is registered under case number 134/Pid.Pra/2026/PB JKT.SEL.
Respondent I in this pretrial motion is the Metro Jaya Regional Police, Respondent II is the Corruption Eradication Corps of the Indonesian National Police, and the Attorney General’s Office as Co-Respondent. This pretrial hearing will enter the evidentiary stage on Thursday (20/8).
